AMENDMENT TO HOUSE BILL 1156




2    AMENDMENT NO. ______. Amend House Bill 1156, AS AMENDED, by 
3inserting the following in its proper numeric sequence:

 
4    "Section 100. The Firearm Owners Identification Card Act is 
5amended  by changing Section 13.1 as follows:
 



6    (430 ILCS 65/13.1)  (from Ch. 38, par. 83-13.1)



7    Sec. 13.1. Preemption. 

8    (a) The provisions of any ordinance enacted by any 
9municipality which
requires registration or imposes greater 
10restrictions or limitations on the
acquisition, possession and 
11transfer of firearms than are imposed by this
Act, are not 
12invalidated or affected by this Act.

13    (b) A unit of local government, including a home rule unit, 
14may not impose any tax, fee, or other assessment other than the 
15normal sales tax rate for goods, on any firearms, firearm 
16attachments, or firearm ammunition. The provisions of any

1ordinance or resolution on or after the effective date of this 
2amendatory Act of the 98th General Assembly by any county 
3government that imposes any tax, fee, or other assessment other 
4than the normal sales tax rate for goods are invalid and all 
5those existing ordinances and resolutions are void. This 
6subsection (b) is a limitation of home rule powers under 
7subsection (h) of Section 6 of Article VII of the Illinois 
8Constitution.
