AMENDMENT TO HOUSE BILL 1156

2    AMENDMENT NO. ______. Amend House Bill 1156, AS AMENDED, by
3inserting the following in its proper numeric sequence:
 
4    "Section 25. Possession, delivery, sale, receipt,
5transfer, or purchase of large capacity ammunition feeding
6device.
7    (a) As used in this Section:
8    "Large capacity ammunition feeding device" means:
9        (1) a magazine, belt, drum, feed strip, or similar
10    device that has a capacity of, or that can be readily
11    restored or converted to accept, more than 10 rounds of
12    ammunition; or
13        (2) any combination of parts from which a device
14    described in paragraph (1) can be assembled.
15    "Large capacity ammunition feeding device" does not
16include an attached tubular device designed to accept, and
17capable of operating only with, .22 caliber rimfire ammunition.

1"Large capacity ammunition feeding device" does not include a
2tubular magazine that is contained in a lever-action firearm or
3any device that has been made permanently inoperable.
4    (b) It is unlawful for any person within this State to
5knowingly deliver, sell, receive, transfer, purchase, or
6possess or cause to be delivered, sold, received, transferred,
7or purchased a large capacity ammunition feeding device.
 
8    Section 27. Exemptions.
9    (a) Section 25 does not apply to or affect any of the
10following:
11        (1) Peace officers as defined in Section 2-13 of the
12    Criminal Code of 2012.
13        (2) Acquisition and possession by a local law
14    enforcement agency for the purpose of equipping the
15    agency's peace officers as defined in paragraph (1) of this
16    subsection.
17        (3) Wardens, superintendents, and keepers of prisons,
18    penitentiaries, jails, and other institutions for the
19    detention of persons accused or convicted of an offense.
20        (4) Members of the Armed Services or Reserve Forces of
21    the United States or the Illinois National Guard, for the
22    performance of their official duties.
23        (5) Any company that employs armed security officers in
24    this State at a nuclear energy, storage, weapons, or
25    development site or facility regulated by the federal

1    Nuclear Regulatory Commission and persons employed as an
2    armed security force member at a nuclear energy, storage,
3    weapons, or development site or facility regulated by the
4    federal Nuclear Regulatory Commission who have completed
5    the background screening and training mandated by the rules
6    and regulations of the federal Nuclear Regulatory
7    Commission for the performance of their official duties.
8        (6) Sale of large capacity ammunition feeding devices
9    to persons authorized under subdivisions (1) through (5) of
10    this subsection (a) to possess those devices.
11        (7) Sale of large capacity ammunition feeding devices
12    for sale or transfer in another state.
13        (8) Sale or rental of large capacity ammunition feeding
14    devices for blank-firing prohibited weapons to persons
15    authorized or permitted, or both authorized and permitted,
16    to acquire these devices for the purpose of rental for use
17    solely as props for a motion picture, television, or video
18    production or entertainment event.".
