SYNOPSIS AS INTRODUCED:
 
ILCON Art. VIII, Sec. 2

    Proposes to amend the Finance Article of the Illinois Constitution. Provides for biennial budgets and appropriations. Defines a "fiscal biennium" as July 1 of each odd-numbered year though June 30 of the ensuing odd-numbered year. Effective upon being declared adopted.

CONSTITUTIONAL AMENDMENT

 
3    RESOLVED, BY THE SENATE OF THE NINETY-SEVENTH GENERAL
4ASSEMBLY OF THE STATE OF ILLINOIS, THE HOUSE OF REPRESENTATIVES
5CONCURRING HEREIN, that there shall be submitted to the
6electors of the State for adoption or rejection at the general
7election next occurring at least 6 months after the adoption of
8this resolution a proposition to amend Section 2 of Article
9VIII of the Illinois Constitution as follows:

13SECTION 2. STATE FINANCE
14    (a) The Governor shall prepare and submit to the General
15Assembly, at a time prescribed by law, a State budget for the
16ensuing fiscal biennium year. The budget shall set forth the
17estimated balance of funds available for appropriation at the
18beginning of the fiscal biennium year, the estimated receipts,
19and a plan for expenditures and obligations during the fiscal
20biennium year of every department, authority, public
21corporation and quasi-public corporation of the State, every
22State college and university, and every other public agency
23created by the State, but not of units of local government or

1school districts. The budget shall also set forth the
2indebtedness and contingent liabilities of the State and such
3other information as may be required by law. Proposed
4expenditures shall not exceed funds estimated to be available
5for the fiscal biennium year as shown in the budget.
6    (b) The General Assembly by law shall make appropriations
7for all expenditures of public funds by the State.
8Appropriations for a fiscal biennium year shall not exceed
9funds estimated by the General Assembly to be available during
10that biennium year.
11    (c) The fiscal biennium shall commence on July 1 of each
12odd-numbered year and end on June 30 of the ensuing
13odd-numbered year.

SCHEDULE
16    This Constitutional Amendment takes effect upon being
17declared adopted in accordance with Section 7 of the Illinois
18Constitutional Amendment Act.
