AMENDMENT TO SENATE BILL 3574

2    AMENDMENT NO. ______. Amend Senate Bill 3574 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Auction License Act is amended by adding
5Section 10-3 as follows:
 
6    (225 ILCS 407/10-3 new)
7    Sec. 10-3. Real estate auctioneer certification.
8    (a) A licensee under this Act may also apply to the
9Department for a real estate auctioneer certification. To
10obtain a real estate auctioneer certification, a licensee shall
11(i) hold a valid auctioneer license, (ii) successfully complete
12a State-approved course of study of at least 30 hours, and
13(iii) pass an exam. A licensee under the Real Estate License
14Act of 2000 shall not have to obtain an auction license or
15certification to conduct a real estate auction.
16    (b) A person who is licensed under this Act and holds a

1real estate auctioneer certification may (i) engage in limited
2activities of an auction for the sale of real estate, (ii)
3specifically establish the time, place, and method of the
4auction, (iii) advertise the auction, and (iv) conduct the
5auction.
6    (c) All other brokerage activities related to the auction
7of real property shall be performed by a licensee under the
8Real Estate License Act of 2000, unless the activities are
9otherwise exempt from the Real Estate License Act of 2000.
10    (d) A managing broker and auctioneer may pay compensation
11to an auctioneer participating in a real estate auction.
12    (e) An auctioneer who violates this Section may be
13considered engaging in the unlicensed practice of real estate,
14and a licensee under the Real Estate License Act of 2000 who
15enabled, aided, or abetted an auctioneer in conducting an
16auction without meeting the requirements of this Section shall
17be in violation of this Act.
 
18    Section 99. Effective date. This Act takes effect upon
19becoming law.".
