AMENDMENT TO SENATE BILL 3341

2    AMENDMENT NO. ______. Amend Senate Bill 3341, AS AMENDED,
3on page 3, line 23, by replacing "Attorney General" with
4"State's Attorney"; and
 
5on page 4, by inserting after line 5 the following:
 
6    "Section 30. The Pawnbroker Regulation Act is amended by
7changing Section 15 as follows:
 
8    (205 ILCS 510/15)
9    Sec. 15. Temporary buying locations; unregistered buyers.
10    (a) For purposes of this Section:
11    "Temporary buying location" means a location used by an
12unregistered buyer, including, but not limited to, hotels and
13motels.
14    "Unregistered buyer" means an individual business, or an
15agent of an individual business, engaged in the business of

1purchasing from the public, scrap precious metals, including,
2but not limited to, jewelry, precious stones, semi-precious
3stones, coins, silver, gold, and platinum, that conducts
4transactions at a temporary buying location but is not
5registered under this Act.
6    (b) An unregistered buyer that seeks to conduct business at
7a temporary buying location in this State must comply with all
8of the following:
9        (1) An unregistered buyer must register with the
10    sheriff of the county at least 30 days prior to its
11    intention to conduct transactions in that county.
12        (2) Except as otherwise provided in Section 10 of the
13    Precious Metal Purchasing Act, an An unregistered buyer
14    must submit by 6 a.m. each day to the sheriff of the county
15    in which he or she is located detailed transaction records
16    for the previous day, which must include purchaser, seller,
17    and inventory information pursuant to subsection (b) of
18    Section 5 of this Act.
19        (3) An unregistered buyer must pay a registration fee
20    to the sheriff of the county in which it seeks to conduct
21    business. This fee shall be used to defray the cost of
22    reviewing the records required under this Section and may
23    be apportioned as the sheriff sees fit.
24    (c) The Department of Financial and Professional
25Regulation may adopt rules necessary for administration of this
26Section, which must include a fee schedule for counties to
