AMENDMENT TO SENATE BILL 3200

2    AMENDMENT NO. ______. Amend Senate Bill 3200 on page 1 by
3replacing lines 21 and 22 with the following:
 
4    "Section 10. Scope and construction.
5    (a) This Act applies to all consumer contracts, except that
6this Act does not apply to format or language required by State
7or federal law or regulation.
8    (b) This Act is to be liberally construed to further its
9purposes, which are to ensure that consumer contracts are
10written in a simple format and plain language and to protect
11consumers against unfair or deceptive form contracts."; and
 
12on page 2, line 19, by changing "8-point" to "10-point"; and
 
13on page 2, line 21, by replacing "paragraphs" with "lines,
14paragraphs,"; and

1on page 4 by replacing line 9 with the following:
 
2"conducted. No consumer contract may contain a waiver of any
3rights granted under this Act."; and
 
4on page 4, line 13, by replacing "violation." with "violation.
5Any person or organization, whether or not a party to a covered
6contract, and any law enforcement official may bring an action
7to enjoin the use of a contract that violates this Act."; and
 
8on page 5 by inserting immediately below line 8 the following:
 
9    "Section 97. Severability. The provisions of this Act are
10severable under Section 1.31 of the Statute on Statutes.".
