AMENDMENT TO SENATE BILL 3047

2    AMENDMENT NO. ______. Amend Senate Bill 3047 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Highway Code is amended by
5changing Section 6-104 as follows:
 
6    (605 ILCS 5/6-104)  (from Ch. 121, par. 6-104)
7    Sec. 6-104. Whenever the territory of any municipality of a
8population of not less than 15,000 is a part of a road district
9two or more road districts in a county not under township
10organization, and shall by resolution of its council or its
11president and board of trustees request the county board to
12organize it into a separate road district and designate the
13name thereof, the county board shall comply with such request,
14and provide for such organization of such municipality into a
15new road district under the name designated in such resolution
16of such city council, or president and board of trustees, if

1any be designated therein.
2    Whenever a road district shall have been or shall hereafter
3be organized as provided in this Section and any of the
4territory of such municipality shall be disconnected from such
5municipality, the county board, upon receipt of a certified
6copy of the resolution or ordinance of the municipality
7disconnecting such territory, by resolution, shall disconnect
8such territory from such road district and annex it to an
9adjacent road district or districts. Whenever such
10municipality, at any one time shall have annexed or shall
11hereafter annex any territory, the county board, by resolution,
12shall disconnect such territory from the road district or
13districts in which it may be situated and annex the same to the
14road district in which such municipality is situated.
15    All the powers vested in a road district organized out of
16the territory embraced within any municipality, including all
17the powers vested by law in the highway commissioner of a road
18district, shall be vested in and exercised by the city council,
19or president and board of trustees of such municipality,
20including the power to levy a tax for the proper construction,
21maintenance and repair of roads in such district as provided in
22Section 6--501 of this Code. Any such tax whether heretofore or
23hereafter levied shall be in addition to all other taxes levied
24in such municipality and in addition to the taxes for general
25purposes authorized in Section 8-3-1 of the Illinois Municipal
26Code, as heretofore and hereafter amended.

1    All of the powers vested by law in the district clerk of a
2road district shall be vested in and exercised by the city,
3town or village clerk of such municipality.
4    After a road district has been organized out of the
5territory embraced within a municipality, the offices and
6election of highway commissioner and district clerk shall be
7discontinued.

9    Section 99. Effective date. This Act takes effect upon
