AMENDMENT TO SENATE BILL 2537

2    AMENDMENT NO. ______. Amend Senate Bill 2537 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Criminal Code of 1961 is amended by adding
5Section 12-21.6-1 as follows:
 
6    (720 ILCS 5/12-21.6-1 new)
7    Sec. 12-21.6-1. Failure to report disappearance of a
8child; failure to report death of a child.
9    (a) A parent, legal guardian, or other person having
10physical custody or control of a child, who is 13 years of age
11or younger, commits failure to report the disappearance of a
12child when he or she fails to notify the appropriate law
13enforcement agency in a timely manner, no later than 24 hours,
14of the child's disappearance; and
15        (1) knows that the child is missing; or
16        (2) reasonably should know that the child is missing.

1    (a-5) Sentence. Failure to report the disappearance of a
2child is a Class 4 felony.
3    (b) A parent, legal guardian, or other person having
4physical custody or control of a child, 17 years of age or
5younger, commits failure to report the death of a child when he
6or she discovers the death of a child and knows or reasonably
7should know that the death of the child occurred under the
8following circumstances and fails to notify the appropriate law
9enforcement agency, in the jurisdiction where the death
10occurred or where the death was discovered, in a timely manner,
11no later than 12 hours, of that discovery:
12        (1) a sudden or violent death, whether apparently
13    suicidal, homicidal, or accidental; or
14        (2) a death where the decedent was not attended by a
15    licensed physician.
16    (b-5) Sentence. Failure to report the death of a child is a
17Class 4 felony.
 
18    Section 99. Effective date. This Act takes effect upon
19becoming law.".
