AMENDMENT TO SENATE BILL 1794

2    AMENDMENT NO. ______. Amend Senate Bill 1794 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The School Code is amended by changing Section
521-28 as follows:
 
6    (105 ILCS 5/21-28)
7    Sec. 21-28. Special education teachers; categorical
8certification.
9    (a) In order to create a special education workforce with
10the broad-based knowledge necessary to educate students with a
11variety of disabilities, the State Board of Education and State
12Teacher Certification Board shall categorically certify a
13special education teacher under one of the following:
14        (1) Learning behavior specialist I.
15        (2) Autism.
16        (3) Mental retardation.

1        (4) Orthopedic (physical) impairment.
2        (5) Traumatic brain injury.
3        (6) Other health impairment.
4        (7) Learning behavior specialist II.
5        (8) Teacher of students who are blind or visually
6    impaired.
7        (9) Teacher of students who are deaf or hard of
8    hearing.
9        (10) Speech-language pathologist.
10        (11) Early childhood special education teacher.
11    (b) The State Board of Education is authorized to provide
12for the assignment of individuals to special education
13positions by short-term, emergency certification. Short-term,
14emergency certification shall not be renewed.
15    (c) The State Board of Education is authorized to use
16peremptory rulemaking, in accordance with Section 5-50 of the
17Illinois Administrative Procedure Act, to place into the
18Illinois Administrative Code the certification policies and
19standards related to special education, as authorized under
20this Section, that the State Board has been required to
21implement pursuant to federal court orders dated February 27,
222001, August 15, 2001, and September 11, 2002 in the matter of
23Corey H., et al. v. Board of Education of the City of Chicago,
24et al. The State Teacher Certification Board shall
25categorically certify a special education teacher in one or
26more of the following specialized categories of disability if

1the special education teacher applies and qualifies for such
2certification:
3        (1) Serious emotional disturbance.
4        (2) Learning disabilities.
5        (3) Autism.
6        (4) Mental retardation.
7        (5) Orthopedic (physical) impairment.
8        (6) Traumatic brain injury.
9        (7) Other health impairment.

11    Section 99. Effective date. This Act takes effect upon
12becoming law.".
