SYNOPSIS AS INTRODUCED:

    Amends the Salaries Act. Provides that, for terms commencing on or after January 10, 2011, the salary of each constitutional officer shall be no more than 90% of the amount last set by the Compensation Review Board. Amends the General Assembly Compensation Act. Provides that, for terms commencing on or after January 12, 2011, each member of the General Assembly shall receive compensation that is no more than 90% of the amount last set by the Compensation Review Board. Amends the Compensation Review Act. For fiscal year 2012 and each fiscal year thereafter, prohibits a cost of living adjustment for General Assembly members and elected executive branch constitutional officers. Effective immediately.

1    AN ACT concerning government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Salaries Act is amended by changing Section
51 as follows:
 
6    (5 ILCS 290/1)  (from Ch. 53, par. 1)
7    Sec. 1. There shall be allowed and paid an annual salary
8in lieu of all other salaries, fees, perquisites, benefit of
9compensation in any form whatsoever, to each of the officers
10herein named, the following respectively.
11        (1) For terms commencing before January 10, 2011:
12            To the Governor, a salary set by the Compensation
13        Review Board, together with the use and occupancy of
14        the executive mansion.
15            To the Lieutenant Governor, a salary set by the
16        Compensation Review Board.
17            To the Secretary of State, a salary set by the
18        Compensation Review Board.
19            To the Comptroller, a salary set by the
20        Compensation Review Board.
21            To the Treasurer, a salary set by the Compensation
22        Review Board.
23            To the Attorney General, a salary set by the

20    Section 10. The General Assembly Compensation Act is
21amended by changing Section 1 as follows:

1shall receive an annual salary of $28,000 or as set by the
2Compensation Review Board, whichever is greater. For terms
3commencing on or after January 12, 2011, each member of the
4General Assembly shall receive an annual salary that is no more
5than 90% of the amount last set by the Compensation Review
6Board.
7    The following named officers, committee chairmen and
8committee minority spokesmen shall receive additional amounts
9per year for their services as such officers, committee
10chairmen and committee minority spokesmen respectively, as set
11by the Compensation Review Board or, as follows, whichever is
12greater: Beginning the second Wednesday in January 1989, the
13Speaker and the minority leader of the House of Representatives
14and the President and the minority leader of the Senate,
15$16,000 each; the majority leader in the House of
16Representatives $13,500; 6 assistant majority leaders and 5
17assistant minority leaders in the Senate, $12,000 each; 6
18assistant majority leaders and 6 assistant minority leaders in
19the House of Representatives, $10,500 each; 2 Deputy Majority
20leaders in the House of Representatives $11,500 each; and 2
21Deputy Minority leaders in the House of Representatives,
22$11,500 each; the majority caucus chairman and minority caucus
23chairman in the Senate, $12,000 each; and beginning the second
24Wednesday in January, 1989, the majority conference chairman
25and the minority conference chairman in the House of
26Representatives, $10,500 each; beginning the second Wednesday

1in January, 1989, the chairman and minority spokesman of each
2standing committee of the Senate, except the Rules Committee,
3the Committee on Committees, and the Committee on Assignment of
4Bills, $6,000 each; and beginning the second Wednesday in
5January, 1989, the chairman and minority spokesman of each
6standing and select committee of the House of Representatives,
7$6,000 each. A member who serves in more than one position as
8an officer, committee chairman, or committee minority
9spokesman shall receive only one additional amount based on the
10position paying the highest additional amount.
11    The compensation provided for in this Section to be paid
12per year to members of the General Assembly, including the
13additional sums payable per year to officers of the General
14Assembly shall be paid in 12 equal monthly installments. The
15first such installment is payable on January 31, 1977. All
16subsequent equal monthly installments are payable on the last
17working day of the month. A member who has held office any part
18of a month is entitled to compensation for an entire month.
19    Mileage shall be paid at the rate of 20 cents per mile
20before January 9, 1985, and at the mileage allowance rate in
21effect under regulations promulgated pursuant to 5 U.S.C.
225707(b)(2) beginning January 9, 1985, for the number of actual
23highway miles necessarily and conveniently traveled by the most
24feasible route to be present upon convening of the sessions of
25the General Assembly by such member in each and every trip
26during each session in going to and returning from the seat of

1government, to be computed by the Comptroller. A member
2traveling by public transportation for such purposes, however,
3shall be paid his or her actual cost of that transportation
4instead of on the mileage rate if his or her cost of public
5transportation exceeds the amount to which he or she would be
6entitled on a mileage basis. No member may be paid, whether on
7a mileage basis or for actual costs of public transportation,
8for more than one such trip for each week the General Assembly
9is actually in session. Each member shall also receive an
10allowance of $36 per day for lodging and meals while in
11attendance at sessions of the General Assembly before January
129, 1985; beginning January 9, 1985, such food and lodging
13allowance shall be equal to the amount per day permitted to be
14deducted for such expenses under the Internal Revenue Code;
15however, beginning May 31, 1995, no allowance for food and
16lodging while in attendance at sessions is authorized for
17periods of time after the last day in May of each calendar
18year, except (i) if the General Assembly is convened in special
19session by either the Governor or the presiding officers of
20both houses, as provided by subsection (b) of Section 5 of
21Article IV of the Illinois Constitution or (ii) if the General
22Assembly is convened to consider bills vetoed, item vetoed,
23reduced, or returned with specific recommendations for change
24by the Governor as provided in Section 9 of Article IV of the
25Illinois Constitution. Notwithstanding any other provision,
26for fiscal year 2011 only (i) the allowance for lodging and

1meals is $111 per day and (ii) mileage for automobile travel
2shall be reimbursed at a rate of $0.39 per mile.
3    If a member dies having received only a portion of the
4amount payable as compensation, the unpaid balance shall be
5paid to the surviving spouse of such member, or, if there be
6none, to the estate of such member.

8    Section 15. The Compensation Review Act is amended by
9changing Section 5.7 and by adding Section 5.8 as follows:

11    Sec. 5.7. FY11 COLA's prohibited. Notwithstanding any
12former or current provision of this Act, any other law, any
13report of the Compensation Review Board, or any resolution of
14the General Assembly to the contrary, members of the General
15Assembly, State's attorneys, other than the county supplement,
16elected executive branch constitutional officers of State
17government, and persons in certain appointed offices of State
18government, including the membership of State departments,
19agencies, boards, and commissions, whose annual compensation
20previously was recommended or determined by the Compensation
21Review Board, are prohibited from receiving and shall not
22receive any increase in compensation that would otherwise apply
23based on a cost of living adjustment, as authorized by Senate
24Joint Resolution 192 of the 86th General Assembly, for or

1during the fiscal year beginning July 1, 2010. That cost of
2living adjustment shall apply again in the fiscal year
3beginning July 1, 2011 and thereafter, except as provided in
4Section 5.8.

7    Sec. 5.8. COLA's prohibited for General Assembly members
8and elected executive branch constitutional officers.
9Notwithstanding any former or current provision of this Act,
10any other law, any report of the Compensation Review Board, or
11any resolution of the General Assembly to the contrary, members
12of the General Assembly and elected executive branch
13constitutional officers of State government are prohibited
14from receiving and shall not receive any increase in
15compensation that would otherwise apply based on a cost of
16living adjustment, as authorized by Senate Joint Resolution 192
17of the 86th General Assembly, for or during the fiscal year
18beginning July 1, 2011 and each fiscal year thereafter.
 
19    Section 99. Effective date. This Act takes effect upon
20becoming law.
