AMENDMENT TO SENATE BILL 1279

2    AMENDMENT NO. ______. Amend Senate Bill 1279 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Lottery Law is amended by changing
5Section 21.5 as follows:
 
6    (20 ILCS 1605/21.5)
7    Sec. 21.5. Carolyn Adams Ticket For The Cure.
8    (a) The Department shall offer a special instant
9scratch-off game with the title of "Carolyn Adams Ticket For
10The Cure". The game shall commence on January 1, 2006 or as
11soon thereafter, in the discretion of the Director, as is
12reasonably practical, and shall be discontinued on December 31,
132016 2011. The operation of the game shall be governed by this
14Act and any rules adopted by the Department. The Department
15must consult with the Carolyn Adams Ticket For The Cure Board,
16which is established under Section 2310-347 of the Department

1of Public Health Powers and Duties Law of the Civil
2Administrative Code of Illinois, regarding the design and
3promotion of the game. If any provision of this Section is
4inconsistent with any other provision of this Act, then this
5Section governs.
6    (b) The Carolyn Adams Ticket For The Cure Grant Fund is
7created as a special fund in the State treasury. The net
8revenue from the Carolyn Adams Ticket For The Cure special
9instant scratch-off game shall be deposited into the Fund for
10appropriation by the General Assembly solely to the Department
11of Public Health for the purpose of making grants to public or
12private entities in Illinois for the purpose of funding
13research concerning breast cancer research, and supportive for
14funding services for breast cancer survivors and those impacted
15by breast cancer and breast cancer education. In awarding
16grants, the Department of Public Health shall consider criteria
17that includes, but is not limited to, projects and initiatives
18that address disparities in incidence and mortality rates of
19breast cancer, based on data from the Illinois Cancer Registry,
20and populations facing barriers to care victims. The Department
21of Public Health shall must, before grants are awarded, provide
22copies of all grant applications to the Carolyn Adams Ticket
23For The Cure Board, receive and review the Board's
24recommendations and comments, and consult with the Board
25regarding the grants. For purposes of this Section, the term
26"research" includes, without limitation, expenditures to

1develop and advance the understanding, techniques, and
2modalities effective in the detection, prevention, screening,
3and treatment of breast cancer and may include clinical trials.
4The grant funds may not be used for institutional,
5organizational, or community-based overhead costs, indirect
6costs, or levies.
7    Moneys received for the purposes of this Section,
8including, without limitation, net revenue from the special
9instant scratch-off game and gifts, grants, and awards from any
10public or private entity, must be deposited into the Fund. Any
11interest earned on moneys in the Fund must be deposited into
12the Fund.
13    For purposes of this subsection, "net revenue" means the
14total amount for which tickets have been sold less the sum of
15the amount paid out in prizes and the actual administrative
16expenses of the Department solely related to the Ticket For The
17Cure game.
18    (c) During the time that tickets are sold for the Carolyn
19Adams Ticket For The Cure game, the Department shall not
20unreasonably diminish the efforts devoted to marketing any
21other instant scratch-off lottery game.
22    (d) The Department may adopt any rules necessary to
23implement and administer the provisions of this Section.

2amended by changing Section 2310-347 as follows:
 
3    (20 ILCS 2310/2310-347)
4    Sec. 2310-347. The Carolyn Adams Ticket For The Cure Board.
5    (a) The Carolyn Adams Ticket For The Cure Board is created
6as an advisory board within the Department. Until 30 days after
7the effective date of this amendatory Act of the 97th General
8Assembly, the The Board may shall consist of 10 members as
9follows: 2 members appointed by the President of the Senate; 2
10members appointed by the Minority Leader of the Senate; 2
11members appointed by the Speaker of the House of
12Representatives; 2 members appointed by the Minority Leader of
13the House of Representatives; and 2 members appointed by the
14Governor with the advice and consent of the Senate, one of whom
15shall be designated as chair of the Board at the time of
16appointment.
17    (a-5) Notwithstanding any provision of this Article to the
18contrary, the term of office of each current Board member ends
1930 days after the effective date of this amendatory Act of the
2097th General Assembly or when his or her successor is appointed
21and qualified, whichever occurs sooner. No later than 30 days
22after the effective date of this amendatory Act of the 97th
23General Assembly, the Board shall consist of 10 newly-appointed
24members. Four of the Board members shall be members of the
25General Assembly and appointed as follows: one member appointed

1by the President of the Senate; one member appointed by the
2Minority Leader of the Senate; one member appointed by the
3Speaker of the House of Representatives; and one member
4appointed by the Minority Leader of the House of
5Representatives.
6    Six of the Board members shall be appointed by the Director
7of the Department of Public Health, who shall designate one of
8these appointed members as chair of the Board at the time of
9his or her appointment. These 6 members appointed by the
10Director shall reflect the population with regard to ethnic,
11racial, and geographical composition and shall include the
12following individuals: one breast cancer survivor; one
13physician specializing in breast cancer or related medical
14issues; one breast cancer researcher; one representative from a
15breast cancer organization; one individual who operates a
16patient navigation program at a major hospital or health
17system; and one breast cancer professional that may include,
18but not be limited to, a genetics counselor, a social worker, a
19detain, an occupational therapist, or a nurse.
20    A Board member whose term has expired may continue to serve
21until a successor is appointed. A Board member who is not a
22member of the General Assembly may serve 2 consecutive 3-year
23terms and shall not be reappointed for 3 years after the
24completion of those consecutive terms.
25    If a vacancy occurs in the Board membership, the vacancy
26shall be filled in the same manner as the initial appointment.

1    (b) Board members shall serve without compensation but may
2be reimbursed for their reasonable travel expenses incurred in
3performing their duties from funds available for that purpose.
4The Department shall provide staff and administrative support
5services to the Board.
6    (c) The Board may advise must:
7        (i) consult with the Department of Revenue in designing
8    and promoting the Carolyn Adams Ticket For The Cure special
9    instant scratch-off lottery game; and
10        (ii) the Department in reviewing review grant
11    applications; and
12        (iii) the Director on the final award of grants , make
13    recommendations and comments, and consult with the
14    Department of Public Health in making grants, from amounts
15    appropriated from the Carolyn Adams Ticket For The Cure
16    Grant Fund, to public or private entities in Illinois that
17    reflect the population with regard to ethnic, racial, and
18    geographical composition for the purpose of funding breast
19    cancer research concerning breast cancer and supportive
20    for funding services for breast cancer survivors and those
21    impacted by breast cancer and breast cancer education. In
22    awarding grants, the Department shall consider criteria
23    that includes, but is not limited to, projects and
24    initiatives that address disparities in incidence and
25    mortality rates of breast cancer, based on data from the
26    Illinois Cancer Registry, and populations facing barriers

1    to care victims in accordance with Section 21.5 of the
2    Illinois Lottery Law.
3    (c-5) The Department shall submit a report to the Governor
4and the General Assembly by December 31 of each year. The
5report shall provide a summary of the Carolyn Adams Ticket for
6the Cure lottery ticket sales, grants awarded, and the
7accomplishments of the grantees.
8    (d) The Board is discontinued on June 30, 2017 2012.

10    Section 99. Effective date. This Act takes effect upon
11becoming law.".
