1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Lottery Law is amended by changing
5Section 21.5 as follows:
 
6    (20 ILCS 1605/21.5)
7    Sec. 21.5. Carolyn Adams Ticket For The Cure.
8    (a) The Department shall offer a special instant
9scratch-off game with the title of "Carolyn Adams Ticket For
10The Cure". The game shall commence on January 1, 2006 or as
11soon thereafter, in the discretion of the Director, as is
12reasonably practical, and shall be discontinued on December 31,
132016 2011. The operation of the game shall be governed by this
14Act and any rules adopted by the Department. The Department
15must consult with the Carolyn Adams Ticket For The Cure Board,
16which is established under Section 2310-347 of the Department
17of Public Health Powers and Duties Law of the Civil
18Administrative Code of Illinois, regarding the design and
19promotion of the game. If any provision of this Section is
20inconsistent with any other provision of this Act, then this
21Section governs.
22    (b) The Carolyn Adams Ticket For The Cure Grant Fund is
23created as a special fund in the State treasury. The net

1revenue from the Carolyn Adams Ticket For The Cure special
2instant scratch-off game shall be deposited into the Fund for
3appropriation by the General Assembly solely to the Department
4of Public Health for the purpose of making grants to public or
5private entities in Illinois for the purpose of funding
6research concerning breast cancer research, and supportive for
7funding services for breast cancer survivors and those impacted
8by breast cancer and breast cancer education. In awarding
9grants, the Department of Public Health shall consider criteria
10that includes, but is not limited to, projects and initiatives
11that address disparities in incidence and mortality rates of
12breast cancer, based on data from the Illinois Cancer Registry,
13and populations facing barriers to care victims. The Department
14of Public Health shall must, before grants are awarded, provide
15copies of all grant applications to the Carolyn Adams Ticket
16For The Cure Board, receive and review the Board's
17recommendations and comments, and consult with the Board
18regarding the grants. For purposes of this Section, the term
19"research" includes, without limitation, expenditures to
20develop and advance the understanding, techniques, and
21modalities effective in the detection, prevention, screening,
22and treatment of breast cancer and may include clinical trials.
23The grant funds may not be used for institutional,
24organizational, or community-based overhead costs, indirect
25costs, or levies.
26    Moneys received for the purposes of this Section,

1including, without limitation, net revenue from the special
2instant scratch-off game and gifts, grants, and awards from any
3public or private entity, must be deposited into the Fund. Any
4interest earned on moneys in the Fund must be deposited into
5the Fund.
6    For purposes of this subsection, "net revenue" means the
7total amount for which tickets have been sold less the sum of
8the amount paid out in prizes and the actual administrative
9expenses of the Department solely related to the Ticket For The
10Cure game.
11    (c) During the time that tickets are sold for the Carolyn
12Adams Ticket For The Cure game, the Department shall not
13unreasonably diminish the efforts devoted to marketing any
14other instant scratch-off lottery game.
15    (d) The Department may adopt any rules necessary to
16implement and administer the provisions of this Section.

18    Section 10. The Department of Public Health Powers and
19Duties Law of the Civil Administrative Code of Illinois is
20amended by changing Section 2310-347 as follows:

22    Sec. 2310-347. The Carolyn Adams Ticket For The Cure Board.
23    (a) The Carolyn Adams Ticket For The Cure Board is created
24as an advisory board within the Department. Until 30 days after

1the effective date of this amendatory Act of the 97th General
2Assembly, the The Board may shall consist of 10 members as
3follows: 2 members appointed by the President of the Senate; 2
4members appointed by the Minority Leader of the Senate; 2
5members appointed by the Speaker of the House of
6Representatives; 2 members appointed by the Minority Leader of
7the House of Representatives; and 2 members appointed by the
8Governor with the advice and consent of the Senate, one of whom
9shall be designated as chair of the Board at the time of
10appointment.
11    (a-5) Notwithstanding any provision of this Article to the
12contrary, the term of office of each current Board member ends
1330 days after the effective date of this amendatory Act of the
1497th General Assembly or when his or her successor is appointed
15and qualified, whichever occurs sooner. No later than 30 days
16after the effective date of this amendatory Act of the 97th
17General Assembly, the Board shall consist of 10 newly appointed
18members. Four of the Board members shall be members of the
19General Assembly and appointed as follows: one member appointed
20by the President of the Senate; one member appointed by the
21Minority Leader of the Senate; one member appointed by the
22Speaker of the House of Representatives; and one member
23appointed by the Minority Leader of the House of
24Representatives.
25    Six of the Board members shall be appointed by the Director
26of the Department of Public Health, who shall designate one of

1these appointed members as chair of the Board at the time of
2his or her appointment. These 6 members appointed by the
3Director shall reflect the population with regard to ethnic,
4racial, and geographical composition and shall include the
5following individuals: one breast cancer survivor; one
6physician specializing in breast cancer or related medical
7issues; one breast cancer researcher; one representative from a
8breast cancer organization; one individual who operates a
9patient navigation program at a major hospital or health
10system; and one breast cancer professional that may include,
11but not be limited to, a genetics counselor, a social worker, a
12detain, an occupational therapist, or a nurse.
13    A Board member whose term has expired may continue to serve
14until a successor is appointed. A Board member who is not a
15member of the General Assembly may serve 2 consecutive 3-year
16terms and shall not be reappointed for 3 years after the
17completion of those consecutive terms.
18    If a vacancy occurs in the Board membership, the vacancy
19shall be filled in the same manner as the initial appointment.
20    (b) Board members shall serve without compensation but may
21be reimbursed for their reasonable travel expenses incurred in
22performing their duties from funds available for that purpose.
23The Department shall provide staff and administrative support
24services to the Board.
25    (c) The Board may advise must:
26        (i) consult with the Department of Revenue in designing

1    and promoting the Carolyn Adams Ticket For The Cure special
2    instant scratch-off lottery game; and
3        (ii) the Department in reviewing review grant
4    applications; and
5        (iii) the Director on the final award of grants , make
6    recommendations and comments, and consult with the
7    Department of Public Health in making grants, from amounts
8    appropriated from the Carolyn Adams Ticket For The Cure
9    Grant Fund, to public or private entities in Illinois that
10    reflect the population with regard to ethnic, racial, and
11    geographical composition for the purpose of funding breast
12    cancer research concerning breast cancer and supportive
13    for funding services for breast cancer survivors and those
14    impacted by breast cancer and breast cancer education. In
15    awarding grants, the Department shall consider criteria
16    that includes, but is not limited to, projects and
17    initiatives that address disparities in incidence and
18    mortality rates of breast cancer, based on data from the
19    Illinois Cancer Registry, and populations facing barriers
20    to care victims in accordance with Section 21.5 of the
21    Illinois Lottery Law.
22    (c-5) The Department shall submit a report to the Governor
23and the General Assembly by December 31 of each year. The
24report shall provide a summary of the Carolyn Adams Ticket for
25the Cure lottery ticket sales, grants awarded, and the
26accomplishments of the grantees.
