1    AN ACT concerning civil liabilities.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Mental Health and Developmental
5Disabilities Confidentiality Act is amended by adding Section
69.4 as follows:
 
7    (740 ILCS 110/9.4 new)
8    Sec. 9.4. Disclosure for treatment and coordination of
9care. For purposes of treatment and coordination of care, State
10agencies, including the Department of Corrections, county
11jails, insurance companies, and integrated health systems, may
12disclose records of a recipient without the recipient's consent
13if the recipient is in a program administered or operated by
14the Department of Healthcare and Family Services or the
15Department of Human Services to hospitals, physicians,
16therapists, emergency medical personnel, and members of an
17interdisciplinary team treating a recipient with or without the
18recipient's consent. Providers on an interdisciplinary care
19team treating a recipient may disclose the recipient's records
20without the recipient's consent to other members of the team.
21The records that may be disclosed under this Section are
22services rendered, providers rendering the services,
23pharmaceuticals prescribed or dispensed, and diagnoses. All

1disclosures under this Section must be made in a manner
2consistent with the federal Health Insurance Portability and
3Accountability Act (HIPAA).
 
4    Section 99. Effective date. This Act takes effect upon
5becoming law.
