1    AN ACT concerning housing.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Housing Authorities Act is amended by
5changing Section 8.1c as follows:
 
6    (310 ILCS 10/8.1c)
7    Sec. 8.1c. Citizens Review Board. A Citizens Review Board
8is established for the the housing authority in any
9municipality having over 500,000 inhabitants to monitor the
10housing authority police force.
11    The Board shall consist of 9 members with 5 appointed by
12the executive director of the housing authority, 2 appointed by
13the housing authority's Central Advisory Council, and 2
14appointed by the housing authority's Senior Advisory Council.
15The initial terms of the members shall be one, 2, 3, 4, and 5
16years for the members appointed by the executive director, one
17and 2 years for the members appointed by the Central Advisory
18Council, and one and 2 years for the members appointed by the
19Senior Advisory Council. The appointing authority shall
20determine which initial term each appointee shall serve. Each
21successor of the initial members shall serve for a term of 4
22years. The initial appointments to the Board shall be made
23within 30 days of the effective date of this amendatory Act of

11997. The Board shall select one of its members to serve as
2chairperson. The Board may, after notice and a hearing, remove
3by majority vote a member of the Board who has been found
4guilty of neglect of duty or malfeasance. If a member of the
5Board resigns or is removed, the official or body that would
6appoint the member's successor shall appoint a person to serve
7the remainder of the member's term. After a member's term
8expires, the member shall continue to serve until a successor
9is appointed and qualified.
10    Subject to collective bargaining agreements, the Board has
11the authority, after holding a hearing, to suspend, terminate,
12or take other disciplinary action against a housing authority
13police officer if:
14        (1) the officer is found by the Board to have
15    physically abused a tenant or his or her guest while the
16    officer was on duty;
17        (2) the officer is found by the Board to have entered
18    the residence of a housing authority tenant and was neither
19    (i) executing a legally issued arrest warrant or search
20    warrant for that residence nor (ii) otherwise lawfully
21    present in the residence; or
22        (3) the officer is found by the Board to have
23    physically abused a person on or off housing authority
24    property while performing his or her duty as a housing
25    authority police officer.
