AMENDMENT TO SENATE BILL 669

2    AMENDMENT NO. ______. Amend Senate Bill 669 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Nurse Practice Act is amended by changing
5Sections 70-50 as follows:
 
6    (225 ILCS 65/70-50)   (was 225 ILCS 65/20-40)
7    (Section scheduled to be repealed on January 1, 2018)
8    Sec. 70-50. Fund.
9    (a) There is hereby created within the State Treasury the
10Nursing Dedicated and Professional Fund. The monies in the Fund
11may be used by and at the direction of the Department for the
12administration and enforcement of this Act, including but not
13limited to:
14        (1) Distribution and publication of this Act and rules.
15        (2) Employment of secretarial, nursing,
16    administrative, enforcement, and other staff for the

1    administration of this Act.
2    (b) Disposition of fees:
3        (1) $5 of every licensure fee shall be placed in a fund
4    for assistance to nurses enrolled in a diversionary program
5    as approved by the Department.
6        (2) All of the fees, fines, and penalties collected
7    pursuant to this Act shall be deposited in the Nursing
8    Dedicated and Professional Fund.
9        (3) Each fiscal year, the moneys deposited in the
10    Nursing Dedicated and Professional Fund shall be
11    appropriated to the Department for expenses of the
12    Department and the Board in the administration of this Act.
13    All earnings received from investment of moneys in the
14    Nursing Dedicated and Professional Fund shall be deposited
15    in the Nursing Dedicated and Professional Fund and shall be
16    used for the same purposes as fees deposited in the Fund.
17        (3.5) For the fiscal year beginning July 1, 2011 and
18    for each fiscal year after July 1, 2011, $1,000,000 of the
19    moneys deposited in the Nursing Dedicated and Professional
20    Fund shall be set aside and appropriated to the Department
21    for the administration of the Illinois Center for Nursing
22    pursuant to Article 75 of this Act.
23        (4) For the fiscal year beginning July 1, 2009 and for
24    each fiscal year thereafter, $2,000,000 of the moneys
25    deposited in the Nursing Dedicated and Professional Fund
26    each year shall be set aside and appropriated to the

1    Department of Public Health for nursing scholarships
2    awarded pursuant to the Nursing Education Scholarship Law.
3    Representatives of the Department and the Nursing
4    Education Scholarship Program Advisory Council shall
5    review this requirement and the scholarship awards every 2
6    years.
7        (5) Moneys in the Fund may be transferred to the
8    Professions Indirect Cost Fund as authorized under Section
9    2105-300 of the Department of Professional Regulation Law
10    (20 ILCS 2105/2105-300).
11    (c) Moneys set aside for nursing scholarships awarded
12pursuant to the Nursing Education Scholarship Law as provided
13in item (4) of subsection (b) of this Section may not be
14transferred under Section 8h of the State Finance Act.

17    Section 99. Effective date. This Act takes effect upon
