AMENDMENT TO SENATE BILL 274

2    AMENDMENT NO. ______. Amend Senate Bill 274 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Disabled Persons Rehabilitation Act is
5amended by changing Section 10a as follows:
 
6    (20 ILCS 2405/10a)
7    Sec. 10a. Financial Participation of Students Attending
8the Illinois School for the Deaf and the Illinois School for
9the Visually Impaired.
10    (a) General. The Illinois School for the Deaf and the
11Illinois School for the Visually Impaired are required to
12provide eligible students with disabilities with a free and
13appropriate public education as required by Article 14 of the
14Illinois School Code. As part of the admission process to
15either school, the Department shall complete a financial
16analysis on each student attending the Illinois School for the

1Deaf or the Illinois School for the Visually Impaired and shall
2ask parents or guardians to participate, if applicable, in the
3cost of identified services or activities that are not
4education related.
5    (b) Financial Participation. The Department shall
6promulgate rules concerning fees for activities or services at
7the schools with input from (i) the superintendent of each
8school and (ii) Directors of Special Education from selected
9Local Education Agencies who place students at the schools.
10Parents or guardians of students attending the Illinois School
11for the Deaf or the Illinois School for the Visually Impaired
12may be asked to financially participate in the following fees
13for services or activities provided at the schools:
14        (1) Registration.
15        (2) Books, labs, and supplies (fees may vary depending
16    on the classes in which a student participates).
17        (3) Athletic or extracurricular activities (students
18    participating in multiple activities will not be required
19    to pay for more than 2 activities).
20        (4) Driver's education (if applicable).
21        (5) Graduation.
22        (6) Yearbook (optional).
23        (7) Activities (trips or leisure activities not
24    associated with classroom curriculum).
25        (8) Other activities or services identified by the
26    Department, pursuant to rule.

1    Exceptions may be granted to parents or guardians who are
2unable to meet the financial participation obligations. The
3Department shall promulgate rules concerning requests for
4exception to the financial participation at the schools.
5    Any fees collected for activities or services identified in
6(1) through (8) under this subsection (b) shall be held locally
7by the school and used exclusively for the purpose for which
8the fee was assessed. A separate locally held fund shall be
9established by the Illinois School for the Deaf and the
10Illinois School for the Visually Impaired for this purpose.
11Completion of financial analysis. Prior to admission, and
12annually thereafter, a financial analysis shall be completed on
13each student attending the Illinois School for the Deaf or the
14Illinois School for the Visually Impaired. If at any time there
15is reason to believe there is a change in the student's
16financial situation that will affect their financial
17participation, a new financial analysis shall be completed.
18        (1) In completing the student's financial analysis,
19    the income of the student's family shall be used. Proof of
20    income must be provided and retained for each parent or
21    guardian.
22        (2) Any funds that have been established on behalf of
23    the student for completion of their primary or secondary
24    education shall be considered when completing the
25    financial analysis.
26        (3) Falsification of information used to complete the

1    financial analysis may result in the Department taking
2    action to recoup monies previously expended by the
3    Department in providing services to the student.
4    (c) (Blank). Financial Participation. Utilizing a sliding
5scale based on income standards developed by rule by the
6Department with input from the superintendent of each school,
7parents or guardians of students attending the Illinois School
8for the Deaf or the Illinois School for the Visually Impaired
9may be asked to financially participate in the following fees
10for services or activities provided at the schools:
11        (1) Registration.
12        (2) Books, labs, and supplies (fees may vary depending
13    on the classes in which a student participates).
14        (3) Room and board for residential students.
15        (4) Meals for day students.
16        (5) Athletic or extracurricular activities (students
17    participating in multiple activities will not be required
18    to pay for more than 2 activities).
19        (6) Driver's education (if applicable).
20        (7) Graduation.
21        (8) Yearbook (optional).
22        (9) Activities (field trips or other leisure
23    activities).
24        (10) Other activities or services identified by the
25    Department.
26    Students, parents, or guardians who are receiving Medicaid

1or Temporary Assistance for Needy Families (TANF) shall not be
2required to financially participate in the fees established in
3this subsection (c).
4    Exceptions may be granted to parents or guardians who are
5unable to meet the financial participation obligations due to
6extenuating circumstances. Requests for exceptions must be
7made in writing and must be submitted to the superintendent for
8initial recommendation with a final determination by the
9Director of the Division of Rehabilitation Services.
10    Any fees collected under this subsection (c) shall be held
11locally by the school and used exclusively for the purpose for
12which the fee was assessed.

14    Section 99. Effective date. This Act takes effect upon
15becoming law.".
