AMENDMENT TO SENATE BILL 266

2    AMENDMENT NO. ______. Amend Senate Bill 266 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Lottery Law is amended by adding
5Sections 10.9 and 21.9 as follows:
 
6    (20 ILCS 1605/10.9 new)
7    Sec. 10.9. Specialty retailer license for community senior
8services and resource centers.
9    (a) The Division shall establish a special classification
10of retailer license to facilitate the year-round sale of the
11instant scratch-off lottery game established under Section
1221.9 of this Act. The fees set forth in Section 10.2 of this
13Act do not apply to a specialty retailer license. The holder of
14a specialty retailer license shall: (i) be a community senior
15services and resource center as established under the Community
16Senior Services and Resources Act; (ii) only sell instant

1scratch-off lottery tickets established under Section 21.9 of
2this Act; (iii) be required to purchase those instant
3scratch-off lottery tickets at face value from the Illinois
4Lottery; and (iv) only sell those tickets at face value.
5Specialty retailer licensees may obtain a refund from the
6Division for any unsold instant scratch-off lottery tickets
7that they have purchased for resale, as set forth in the
8specialty retailer agreement.
9    (b) A specialty retailer licensee shall receive a sales
10commission equal to 2% of the face value of specialty game
11tickets purchased from the Department, less adjustments for
12unsold tickets returned to the Illinois Lottery for credit. A
13specialty retailer licensee may not cash winning tickets, but
14are entitled to a 1% bonus in connection with the sale of a
15winning specialty game ticket having a price value of $1,000 or
16more.
 
17    (20 ILCS 1605/21.9 new)
18    Sec. 21.9. Scratch-off for Seniors.
19    (a) The Department shall offer a special instant
20scratch-off game for the benefit of Illinois seniors with the
21title of "Scratch-off for Seniors". The game shall commence on
22July 1, 2011 or as soon thereafter, at the discretion of the
23Director, as is reasonably practical. The operation of the game
24shall be governed by this Act and any rules adopted by the
25Department. If any provision of this Section is inconsistent

1with any other provision of this Act, then this Section
2governs.
3    (b) The net revenue from the Scratch-Off for Seniors game
4shall be deposited into the Community Senior Services and
5Resources Fund for appropriation by the General Assembly to the
6Department of Aging for the purpose of making grants to
7community senior services and resource centers as established
8under the Community Senior Services and Resources Act.
9    Moneys collected from the Scratch-Off for Seniors game
10shall be used only as supplemental financial resources and
11shall not supplant existing moneys that the Department on Aging
12may currently expend on community senior services and resource
13centers.
14    Moneys received for the purposes of this Section,
15including, without limitation, net revenue from the
16Scratch-Off for Seniors game and from gifts, grants, and awards
17from any public or private entity, must be deposited into the
18Fund. Any interest earned on moneys in the Fund must be
19deposited into the Fund.
20    For purposes of this subsection (b), "net revenue" means
21the total amount for which tickets have been sold less the sum
22of the amount paid out in prizes and the actual administrative
23expenses of the Department solely related to the Scratch-Off
24for Seniors game under this Section.
25    (c) The Department shall not unreasonably diminish the
26efforts devoted to marketing any other instant scratch-off

1lottery game as a result of selling tickets for the Scratch-Off
2for Seniors game.
3    (d) The Department may adopt any rules necessary to
4implement and administer the provisions of this Section.
 
5    Section 99. Effective date. This Act takes effect upon
6becoming law.".
