SYNOPSIS AS INTRODUCED:
 
110 ILCS 205/9.16  from Ch. 144, par. 189.16

    Amends the Board of Higher Education Act. In a Section concerning the underrepresentation of certain groups in higher education, requires the Board of Higher Education to require all public institutions of higher education to track the status of those students who are the first in their family to attend an institution of higher education. With respect to the Board's annual report to the General Assembly and the Governor, requires the report to include, with respect to each public institution of higher education, the status of those students who are the first in their family to attend an institution of higher education.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Board of Higher Education Act is amended by
5changing Section 9.16 as follows:
 
6    (110 ILCS 205/9.16)  (from Ch. 144, par. 189.16)
7    Sec. 9.16. Underrepresentation of certain groups in higher
8education. To require public institutions of higher education
9to develop and implement methods and strategies to increase the
10participation of minorities, women and handicapped individuals
11who are traditionally underrepresented in education programs
12and activities. For the purpose of this Section, minorities
13shall mean persons who are citizens of the United States or
14lawful permanent resident aliens of the United States and who
15are: (a) Black (a person having origins in any of the black
16racial groups in Africa); (b) Hispanic (a person of Spanish or
17Portuguese culture with origins in Mexico, South or Central
18America, or the Caribbean, regardless of race); (c) Asian
19American (a person having origins in any of the original people
20of the Far East, Southeast Asia, the Indian Subcontinent or the
21Pacific Islands); or (d) American Indian or Alaskan Native (a
22person having origins in any of the original people of North
23America).

1    The Board shall adopt any rules necessary to administer
2this Section. The Board shall also do the following:
3    (a) require all public institutions of higher education to
4develop and submit plans for the implementation of this
5Section;
6    (b) conduct periodic review of public institutions of
7higher education to determine compliance with this Section; and
8if the Board finds that a public institution of higher
9education is not in compliance with this Section, it shall
10notify the institution of steps to take to attain compliance;
11    (c) provide advice and counsel pursuant to this Section;
12    (d) conduct studies of the effectiveness of methods and
13strategies designed to increase participation of students in
14education programs and activities in which minorities, women
15and handicapped individuals are traditionally
16underrepresented, and monitor the success of students in such
17education programs and activities;
18    (e) encourage minority student recruitment and retention
19in colleges and universities. In implementing this paragraph,
20the Board shall undertake but need not be limited to the
21following: the establishment of guidelines and plans for public
22institutions of higher education for minority student
23recruitment and retention, the review and monitoring of
24minority student programs implemented at public institutions
25of higher education to determine their compliance with any
26guidelines and plans so established, the determination of the

1effectiveness and funding requirements of minority student
2programs at public institutions of higher education, the
3dissemination of successful programs as models, and the
4encouragement of cooperative partnerships between community
5colleges and local school attendance centers which are
6experiencing difficulties in enrolling minority students in
7four-year colleges and universities;
8    (e-5) require all public institutions of higher education
9to track the status of those students who are the first in
10their family to attend an institution of higher education;
11    (f) mandate all public institutions of higher education to
12submit data and information essential to determine compliance
13with this Section. The Board shall prescribe the format and the
14date for submission of this data and any other education equity
15data; and
16    (g) report to the General Assembly and the Governor
17annually with a description of the plans submitted by each
18public institution of higher education for implementation of
19this Section, including financial data relating to the most
20recent fiscal year expenditures for specific minority
21programs, the effectiveness of such plans and programs and the
22effectiveness of the methods and strategies developed by the
23Board in meeting the purposes of this Section, the degree of
24compliance with this Section by each public institution of
25higher education as determined by the Board pursuant to its
26periodic review responsibilities, and the findings made by the

1Board in conducting its studies and monitoring student success
2as required by paragraph d) of this Section. With respect to
3each public institution of higher education such report also
4shall include, but need not be limited to, information with
5respect to each institution's minority program budget
6allocations; minority student admission, retention and
7graduation statistics; number of financial assistance awards
8to undergraduate and graduate minority students; and minority
9faculty representation; and the status of those students who
10are the first in their family to attend an institution of
11higher education. This paragraph shall not be construed to
12prohibit the Board from making, preparing or issuing additional
13surveys or studies with respect to minority education in
14Illinois.
