2 | | WHEREAS, According to the Des Plaines, Illinois-based |
3 | | National Insurance Crime Bureau (NICB), during the past 3 |
4 | | years, there has been a significant increase in insurance |
5 | | fraud, specifically in Illinois, staged motor vehicle |
6 | | accidents, false claims of bodily injury, and medical provider |
7 | | fraud; and
|
8 | | WHEREAS, Illinois ranks fifth nationally in submitted |
9 | | questionable claims related to bodily injury; and
|
10 | | WHEREAS, Illinois has adequate insurance fraud laws, |
11 | | especially in relation to immunity for reporting and sharing |
12 | | information; and
|
13 | | WHEREAS, Illinois has strong criminal penalties for |
14 | | insurance fraud; and
|
15 | | WHEREAS, A fraud bureau exists to investigate workers' |
16 | | compensation fraud; and
|
17 | | WHEREAS, Illinois has a Motor Vehicle Theft Prevention |
18 | | Council, funded by a $1 charge per auto insurance policy, that |
19 | | helps combat vehicle theft and has contributed to a 60% decline |
20 | | in vehicle theft since 1991; and
|

1 | | WHEREAS, A bureau or other facility to investigate property |
2 | | and casualty and medical fraud does not exist; and
|
3 | | WHEREAS, The top recommendation arising from the 2008 |
4 | | Illinois Insurance Fraud Summit held by the NICB was the need |
5 | | for a dedicated insurance fraud prosecutor; therefore, be it
|
6 | | RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE |
7 | | NINETY-SEVENTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that |
8 | | there is created the Illinois Insurance Fraud Task Force; and |
9 | | be it further

10 | | RESOLVED, That the Task Force shall be composed of the |
11 | | following members: the Director of the Illinois Department of |
12 | | Insurance or his or her designee, the Director of the Illinois |
13 | | State Police or his or her designee, the Director of the |
14 | | Criminal Justice Information Authority or his or her designee; |
15 | | the Attorney General or his or her designee; the Cook County |
16 | | State's Attorney or his or her designee; the Superintendent of |
17 | | the Chicago Police Department or his or her designee; a local |
18 | | Police Chief designated by the Illinois Association of Chiefs |
19 | | of Police; a County Sheriff designated by the Illinois County |
20 | | Sheriff's Association; three property and casualty insurance |
21 | | companies designated by the Illinois Insurance Association; |
22 | | the President of the National Insurance Crime Bureau or his or |

1 | | her designee; the President of the Illinois Insurance |
2 | | Association or his or her designee; and the Governor of the |
3 | | State of Illinois or his or her designee; and be it further
|
4 | | RESOLVED, That at the first meeting of the Task Force a |
5 | | chairperson be selected from among its members; and be it |
6 | | further |
7 | | RESOLVED, That the Illinois Insurance Fraud Task Force |
8 | | shall (i) investigate the issue of organized insurance fraud |
9 | | crime, especially as related to the rapidly escalating problem |
10 | | of medical fraud, (ii) examine methods to unite the collective |
11 | | resources of the insurance industry with appropriate |
12 | | components of federal, State, and local law enforcement |
13 | | agencies to pinpoint organized criminal schemes, and (iii) |
14 | | examine concepts for establishing a permanent and financially |
15 | | sustained public-private partnership to combat insurance fraud |
16 | | crimes with emphasis placed on the establishment of a dedicated |
17 | | investigative and prosecutorial focus on insurance fraud |
18 | | crimes; and be it further |
19 | | RESOLVED, That the Illinois Insurance Fraud Task Force |
20 | | submit a report of its findings and recommendations to this |
21 | | body on or before August 30, 2013.
