SYNOPSIS AS INTRODUCED:

    Amends the Children's Health Insurance Program Act, the Covering ALL KIDS Health Insurance Act, and the Medical Assistance Article of the Illinois Public Aid Code. Removes language providing that there shall be a 2-year moratorium on eligibility expansions under the Children's Health Insurance Program, the Covering ALL KIDS Health Insurance program, and the State's medical assistance program and instead provides that the moratorium shall be in effect for either (i) a period of 2 years after January 25, 2011 (the effective date of Public Act 96-1501), or (ii) until the State expands eligibility for legal residents with incomes up to 133% of the federal poverty level as mandated by the provisions of the federal Patient Protection and Affordable Care Act of 2010, whichever is longer. Effective immediately.

1    AN ACT concerning public aid.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Children's Health Insurance Program Act is
5amended by changing Section 26 as follows:
 
6    (215 ILCS 106/26)
7    Sec. 26. Moratorium on eligibility expansions. Beginning
8on the effective date of this amendatory Act of the 96th
9General Assembly, there shall be a 2-year moratorium on the
10expansion of eligibility through increasing financial
11eligibility standards, or through increasing income
12disregards, or through the creation of new programs that would
13add new categories of eligible individuals under the medical
14assistance program under the Illinois Public Aid Code in
15addition to those categories covered on January 1, 2011. This
16moratorium shall not apply to expansions required as a federal
17condition of State participation in the medical assistance
18program.
19    This moratorium shall be in effect either (i) for a period
20of 2 years after January 25, 2011 (the effective date of Public
21Act 96-1501), or (ii) until the State expands eligibility for
22legal residents with incomes up to 133% of the federal poverty
23level as mandated by the provisions of the federal Patient

4    Section 10. The Covering ALL KIDS Health Insurance Act is
5amended by changing Section 36 as follows:

5changing Section 5-1.4 as follows:
 
6    (305 ILCS 5/5-1.4)
7    Sec. 5-1.4. Moratorium on eligibility expansions.
8Beginning on the effective date of this amendatory Act of the
996th General Assembly, there shall be a 2-year moratorium on
10the expansion of eligibility through increasing financial
11eligibility standards, or through increasing income
12disregards, or through the creation of new programs which would
13add new categories of eligible individuals under the medical
14assistance program in addition to those categories covered on
15January 1, 2011. This moratorium shall not apply to expansions

2    Section 99. Effective date. This Act takes effect upon
3becoming law.
