55 ILCS 5/5-1104.1  from Ch. 34, par. 5-1104.1

    Amends the Counties Code. Authorizes a county to enter into an intergovernmental agreement with any forest preserve district that exempts the district from compliance with county zoning ordinances. Effective immediately.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Counties Code is amended by changing Section
55-1104.1 as follows:
 
6    (55 ILCS 5/5-1104.1)  (from Ch. 34, par. 5-1104.1)
7    Sec. 5-1104.1. If a forest preserve district organized
8under the Downstate Forest Preserve District Act has, either
9before or after the effective date of this amendatory Act of
101991, adopted a comprehensive policy for the management and
11maintenance of the streams, lakes, ponds and water courses
12located on the property owned by the district, the power
13conferred on a county board under Section 5-1104 shall be
14exercised in a manner consistent with such comprehensive policy
15and only pursuant to an intergovernmental agreement between the
16forest preserve district and the county specifying in detail
17the respective obligations of the parties.
18    A county may enter into an intergovernmental agreement with
19any forest preserve district within the county that exempts the
20forest preserve district from compliance with county zoning
21ordinances.

1    Section 99. Effective date. This Act takes effect upon
2becoming law.
