AMENDMENT TO HOUSE BILL 5641

2    AMENDMENT NO. ______. Amend House Bill 5641 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Public Aid Code is amended by
5adding Section 5-1.2a as follows:
 
6    (305 ILCS 5/5-1.2a new)
7    Sec. 5-1.2a. Program integrity assurance system.
8    (a) Income eligibility verification system; purpose. It is
9the intent of the General Assembly that the Department shall
10establish a computerized income eligibility verification
11system in order to verify eligibility, improve efficiency,
12eliminate duplication of assistance, and deter fraud.
13    (b) Report. The Department's Inspector General, in
14collaboration with other appropriate units of State
15government, shall review and complete a report of data sources
16to determine their availability and appropriateness to

1fulfilling the purpose of this Section. The data sources that
2shall be reviewed include the following:
3        (A) Unearned income information maintained by the
4    Internal Revenue Service.
5        (B) Employer quarterly reports of income and
6    unemployment insurance payment information maintained by
7    the Department of Employment Security.
8        (C) Earned income information maintained by the Social
9    Security Administration.
10        (D) Immigration status information maintained by the
11    U.S. Citizenship and Immigration Services.
12        (E) Death register information maintained by the
13    Social Security Administration.
14        (F) Prisoner information maintained by the Social
15    Security Administration.
16        (G) Public housing and Section 8 Housing Assistance
17    payment information maintained by the Department of
18    Housing and Urban Development.
19        (H) National fleeing felon information maintained by
20    the Federal Bureau of Investigation.
21        (I) Wage reporting and similar information maintained
22    by states contiguous to this State.
23        (J) Beneficiary records and earnings information
24    maintained by the Social Security Administration in its
25    Beneficiary and Earnings Data Exchange (BENDEX) database.
26        (K) Earnings and pension information maintained by the

1    Social Security Administration in its Beneficiary Earnings
2    Exchange Record System (BEERS) database.
3        (L) Employment information maintained by the
4    Department of Employment Security in its New Hire Directory
5    database.
6        (M) Employment information maintained by the U.S.
7    Department of Health and Human Services in its National
8    Directory of New Hires database.
9        (N) Supplemental Security Income information
10    maintained by the Social Security Administration in its SSI
11    State Data Exchange (SDX) database.
12        (O) Veterans' benefits information maintained by the
13    U.S. Department of Health and Human Services, in
14    coordination with the Department of Human Services and the
15    Department of Veterans' Affairs, in the federal Public
16    Assistance Reporting Information System (PARIS) database.
17        (P) Child care services information maintained by the
18    Department of Human Services under its Child Care
19    Assistance Program.
20        (Q) Utility payments information maintained by the
21    Department of Commerce and Economic Opportunity under the
22    Low Income Home Energy Assistance Program.
23        (R) A database which is substantially similar to or a
24    successor of a database established in this subsection.
25        (S) The database of all persons who currently hold a
26    license, permit, or certificate from a State agency the

1    cost of which exceeds $1,000.
2    Such report shall be submitted to the Governor and the
3General Assembly no later than January 2, 2013.
4    (c) Rules. The Department shall promulgate any rules
5necessary to implement this Section pursuant to the
6Administrative Procedure Act.
 
7    Section 99. Effective date. This Act takes effect upon
8becoming law.".
