    Amends the State Universities Article of the Illinois Pension Code. Provides that if an employer notifies the State Universities Retirement System that it has employed an annuitant for more than 100 paid days or 500 paid hours in a school year, then the System shall certify to the employer the current value of the annual retirement annuity of that annuitant. Provides that if an employer receives such a certification, then the employer shall pay the certified amount to the System within one year after receiving the certification. Amends the University of Illinois Act, Southern Illinois University Management Act, Chicago State University Law, Eastern Illinois University Law, Governors State University Law, Illinois State University Law, Northeastern Illinois University Law, Northern Illinois University Law, Western Illinois University Law, and Public Community College Act to make conforming changes. Effective July 1, 2012.

1    AN ACT concerning public employee benefits.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Pension Code is amended by adding
5Section 15-139.1 as follows:
 
6    (40 ILCS 5/15-139.1 new)
7    Sec. 15-139.1. Employed annuitant certification. If an
8employer notifies the System that the employer has employed an
9annuitant for more than 100 paid days or 500 paid hours in a
10school year, then the System shall certify to the employer the
11current value of the annual retirement annuity of that
12annuitant. If an employer receives such a certification, then
13the employer shall pay the certified amount to the System
14within one year after receiving the certification.
 
15    Section 10. The University of Illinois Act is amended by
16adding Section 80 as follows:

18    Sec. 80. Employment of annuitants of State Universities
19Retirement System. The University of Illinois may employ an
20annuitant for up to 100 paid days or 500 paid hours per school

2if the University of Illinois also pays to the State
3Universities Retirement System an amount equal to the annual

7Universities Retirement System. The University of Illinois
8must determine if an employee is an annuitant and shall notify
9the State Universities Retirement System when the university
10employs an annuitant for more than 100 paid days or 500 paid
11hours in a school year. For the purposes of this Section,
12"annuitant" means any individual that is receiving a retirement
13annuity from the State Universities Retirement System.
 
14    Section 15. The Southern Illinois University Management
15Act is amended by adding Section 65 as follows:

17    Sec. 65. Employment of annuitants of State Universities
18Retirement System. Southern Illinois University may employ an
19annuitant for up to 100 paid days or 500 paid hours per school
20year. Southern Illinois University may employ an annuitant for
21more than 100 paid days or 500 paid hours per school year only
22if Southern Illinois University also pays to the State
23Universities Retirement System an amount equal to the annual
24retirement annuity of that annuitant. Such payment shall be due

11adding Section 5-175 as follows:

14Retirement System. Chicago State University may employ an
15annuitant for up to 100 paid days or 500 paid hours per school
16year. Chicago State University may employ an annuitant for more
17than 100 paid days or 500 paid hours per school year only if
18Chicago State University also pays to the State Universities
19Retirement System an amount equal to the annual retirement
20annuity of that annuitant. Such payment shall be due within one
21year after Chicago State University receives the certification
22of the certified amount from the State Universities Retirement
23System. Chicago State University must determine if an employee

11may employ an annuitant for up to 100 paid days or 500 paid
12hours per school year. Eastern Illinois University may employ
13an annuitant for more than 100 paid days or 500 paid hours per
14school year only if Eastern Illinois University also pays to
15the State Universities Retirement System an amount equal to the
16annual retirement annuity of that annuitant. Such payment shall
17be due within one year after Eastern Illinois University
18receives the certification of the certified amount from the
19State Universities Retirement System. Eastern Illinois
20University must determine if an employee is an annuitant and

9per school year. Governors State University may employ an

12State Universities Retirement System an amount equal to the
13annual retirement annuity of that annuitant. Such payment shall
14be due within one year after Governors State University
15receives the certification of the certified amount from the
16State Universities Retirement System. Governors State
17University must determine if an employee is an annuitant and
18shall notify the State Universities Retirement System when the
19university employs an annuitant for more than 100 paid days or
20500 paid hours in a school year. For the purposes of this
21Section, "annuitant" means any individual that is receiving a
22retirement annuity from the State Universities Retirement

2Universities Retirement System. Northeastern Illinois
3University may employ an annuitant for up to 100 paid days or
4500 paid hours per school year. Northeastern Illinois
5University may employ an annuitant for more than 100 paid days
6or 500 paid hours per school year only if Northeastern Illinois
7University also pays to the State Universities Retirement
8System an amount equal to the annual retirement annuity of that
9annuitant. Such payment shall be due within one year after
10Northeastern Illinois University receives the certification of
11the certified amount from the State Universities Retirement
12System. Northeastern Illinois University must determine if an
13employee is an annuitant and shall notify the State
14Universities Retirement System when the university employs an

13    Section 55. The Public Community College Act is amended by
14adding Section 3-29-10 as follows:

16    Sec. 3-29-10. Employment of annuitants of State
17Universities Retirement System. A community college may employ
18an annuitant for up to 100 paid days or 500 paid hours per
19school year. A community college may employ an annuitant for
20more than 100 paid days or 500 paid hours per school year only
21if that community college also pays to the State Universities
22Retirement System an amount equal to the annual retirement
23annuity of that annuitant. Such payment shall be due within one
24year after the community college receives the certification of

2System. Each community college must determine if an employee is
3an annuitant and shall notify the State Universities Retirement
4System when the community college employs an annuitant for more
5than 100 paid days or 500 paid hours in a school year. For the
6purposes of this Section, "annuitant" means any individual that
7is receiving a retirement annuity from the State Universities
8Retirement System.
 
9    Section 99. Effective date. This Act takes effect on July
101, 2012.
