AMENDMENT TO HOUSE BILL 4496

2    AMENDMENT NO. ______. Amend House Bill 4496 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Plumbing License Law is amended by
5changing Section 35 as follows:
 
6    (225 ILCS 320/35)  (from Ch. 111, par. 1133)
7    Sec. 35. The Department shall promulgate and publish and
8may from time to time amend a minimum code of standards for
9plumbing and the fixtures, materials, design and installation
10methods of plumbing systems based upon the findings of the
11sciences of pneumatics and hydraulics, after consideration of
12the recommendations of the Plumbing Code Advisory Council. By
13January 1, 2013, the Plumbing Code Advisory Council shall
14recommend amendments to the existing minimum code of standards
15for plumbing and the fixtures, materials, design, and
16installation methods of plumbing systems to reflect advances in

1those technologies and methods that more efficiently utilize
2natural resources and protect public health. Upon
3consideration of those recommendations, the Department shall
4submit the amendments to the existing minimum code of standards
5to the Joint Committee on Administrative Rules by May 31, 2013.
6The Department may promulgate and publish rules in the State's
7minimum code of standards for the minimum number of plumbing
8fixtures required for the comfort and convenience of workers
9and the public not inconsistent with, but not limited to, the
10requirements of the federal Americans With Disabilities Act,
11the Equitable Restrooms Act, and the U.S. Department of Labor,
12Office of Safety and Health Administration. The minimum code of
13standards for plumbing and any amendments thereto shall be
14filed with the Secretary of State as a public record. In
15preparing plumbing code standards and amendments thereto the
16Department may give consideration to the recommendations
17contained in nationally recognized plumbing codes and
18recommendations of nationally recognized material and
19equipment testing laboratories. The plumbing code promulgated
20by the Department under authority of this Act shall remain in
21effect as the minimum code authorized by this Act until the
22Department promulgates a new code under authority of this Act.
23At least 20 days' notice of a public hearing shall be given by
24the Department in a manner which the Department considers
25adequate to bring the hearing to the attention of persons
26interested in plumbing code standards. Notice of any public

1hearing shall be given by the Department to those who file a
2request for a notice of hearings.
