AMENDMENT TO HOUSE BILL 4466

2    AMENDMENT NO. ______. Amend House Bill 4466, on page 8,
3line 20, after "amended", by inserting "by changing Section 27
4and"; and
 
5on page 8, immediately below line 21, by inserting the
6following:
 
7    (230 ILCS 40/27)
8    Sec. 27. Prohibition of video gaming by political
9subdivision. Except as otherwise provided in this Section, a A
10municipality may pass an ordinance after July 13, 2009
11prohibiting video gaming within the corporate limits of the
12municipality. Except as otherwise provided in this Section, a A
13county board may, for the unincorporated area of the county,
14pass an ordinance after July 13, 2009 prohibiting video gaming
15within the unincorporated area of the county.
16    An ordinance adopted prior to July 13, 2009 by the City of

1Chicago shall be deemed a prohibition of video gaming under
2this Section. No other law or ordinance adopted prior to July
313, 2009 providing any prohibition, penalty, or disability for
4the use of video gaming terminals or any acts done in
5connection with video gaming terminals shall apply to the use
6of video gaming terminals or acts done in connection with video
7gaming terminals pursuant to this Act.
8    A home rule unit may not prohibit video gaming in a manner
9inconsistent with the provisions of this Section. This Section
10is a limitation under subsection (i) of Section 6 of Article
11VII of the Illinois Constitution on the concurrent exercise by
12home rule units of powers and functions exercised by the State.
