SYNOPSIS AS INTRODUCED:
 
605 ILCS 10/32.1 new

    Amends the Toll Highway Act. Provides that upon written approval by the Governor, the Toll Highway Authority may exercise any powers it has under the Toll Highway Act on the effective date of the amendatory Act to design and construct new railroad tracks. Provides that the Authority may charge an access fee to any passenger or freight rail operator who wishes to use tracks which the Authority has constructed using powers granted under the amendatory Act. Provides that moneys in the Road Fund may not be used to implement the new provisions. Provides that authorization must be granted to the Authority for each individual and distinct railroad track project. Effective immediately.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Toll Highway Act is amended by adding
5Section 32.1 as follows:
 
6    (605 ILCS 10/32.1 new)
7    Sec. 32.1. Power to construct railroad tracks. Upon written
8approval by the Governor, the Authority may exercise any powers
9that exist under this Act on the effective date of this
10amendatory Act of the 97th General Assembly to design and
11construct new railroad tracks. The Authority may charge an
12access fee to any passenger or freight rail operator who wishes
13to use tracks which the Authority has constructed using the
14powers granted by this Section. Moneys in the Road Fund may not
15be used to implement this Section. Authorization must be
16granted to the Authority for each individual and distinct
17railroad track project.
 
18    Section 99. Effective date. This Act takes effect upon
19becoming law.
