AMENDMENT TO HOUSE BILL 3816

2    AMENDMENT NO. ______. Amend House Bill 3816 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Gubernatorial Boards and Commissions Act is
5amended by adding Section 25 as follows:
 
6    (15 ILCS 50/25 new)
7    Sec. 25. Dissolution of inactive boards and commissions.
8    (a) Within 30 days after the effective date of this
9amendatory Act of the 97th General Assembly, each statutorily
10created board or commission not subject to subsection (e) shall
11report to the Secretary of State on that board's or
12commission's last meeting prior to the effective date of this
13amendatory Act of the 97th General Assembly, and the report
14shall include the date, time, and location of the meeting.
15Within 30 days after receiving the reports, the Secretary of
16State shall submit a report to the Governor, the Secretary of

1the Senate, and the Clerk of the House of Representatives,
2listing all statutorily created boards and commissions that
3have not met in the 2 years immediately preceding the effective
4date of this amendatory Act of the 97th General Assembly. If a
5board or commission not subject to subsection (e) does not
6report to the Secretary of State pursuant to this subsection,
7then it shall be deemed to be inactive and subject to the
8provisions of subsections (b) and (c).
9    (b) Unless the Governor acts pursuant to subsection (c), if
10a board or commission has not met at least once during the 2
11years prior to the effective date of this amendatory Act of the
1297th General Assembly and is reported as inactive pursuant to
13subsection (a), then the board or commission is dissolved at
14the end of the 60-day period set forth in subsection (c).
15    (c) Within 60 days after receipt of the report by the
16Secretary of State, the Governor may prevent the dissolution of
17any inactive board or commission by filing a written statement
18with the Secretary of State and the Senate that authorizes the
19continued existence of the board or commission and provides a
20rationale for why the board or commission needs to exist.
21    (d) Within 14 days after the 60-day period set forth in
22subsection (c), the Governor shall publish a list of all boards
23and commissions dissolved under subsection (b). The
24Legislative Reference Bureau shall prepare for introduction no
25later than in the annual session of the General Assembly next
26occurring after the list is published by the Governor a

1revisory bill effecting such changes in the statutes as may be
2necessary to conform the statutes to the changes in law made by
3the dissolution of the boards and commissions included in the
4list published by the Governor. The failure of the General
5Assembly to enact such a bill does not affect the validity of
6the dissolution of any board or commission under this Section.
7    (e) Any board or commission created after July 1, 2010 is
8exempt from this Section.
 
9    Section 99. Effective date. This Act takes effect upon
10becoming law.".
