SYNOPSIS AS INTRODUCED:

    Amends the Firearm Owners Identification Card Act. Provides that, except for reasons specified in the Act relating to revocation of a Firearm Owner's Identification Card, a Firearm Owner's Identification Card issued under the provisions of the Act on or after the effective date of this amendatory Act shall be valid for the natural life of the person to whom it is issued.

1    AN ACT concerning firearms.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Firearm Owners Identification Card Act is
5amended by changing Sections 6, 7, and 13.2 as follows:
 
6    (430 ILCS 65/6)  (from Ch. 38, par. 83-6)
7    Sec. 6. Contents of Firearm Owner's Identification Card.
8    (a) A Firearm Owner's Identification Card, issued by the
9Department of State Police at such places as the Director of
10the Department shall specify, shall contain the applicant's
11name, residence, date of birth, sex, physical description,
12recent photograph and signature. Each Firearm Owner's
13Identification Card must have the expiration date boldly and
14conspicuously displayed on the face of the card. Each Firearm
15Owner's Identification Card must have printed on it the
16following: "CAUTION - This card does not permit bearer to
17UNLAWFULLY carry or use firearms." Before December 1, 2002, the
18Department may use a person's digital photograph and signature
19from his or her Illinois driver's license or Illinois
20Identification Card, if available. On and after December 1,
212002, the Department shall use a person's digital photograph
22and signature from his or her Illinois driver's license or
23Illinois Identification Card, if available. The Department

1shall decline to use a person's digital photograph or signature
2if the digital photograph or signature is the result of or
3associated with fraudulent or erroneous data, unless otherwise
4provided by law.
5    (b) A person applying for a Firearm Owner's Identification
6Card shall consent to the Department of State Police using the
7applicant's digital driver's license or Illinois
8Identification Card photograph, if available, and signature on
9the applicant's Firearm Owner's Identification Card. The
10Secretary of State shall allow the Department of State Police
11access to the photograph and signature for the purpose of
12identifying the applicant and issuing to the applicant a
13Firearm Owner's Identification Card.
14    (c) The Secretary of State shall conduct a study to
15determine the cost and feasibility of creating a method of
16adding an identifiable code, background, or other means on the
17driver's license or Illinois Identification Card to show that
18an individual is not disqualified from owning or possessing a
19firearm under State or federal law. The Secretary shall report
20the findings of this study 12 months after the effective date
21of this amendatory Act of the 92nd General Assembly.

24    Sec. 7. Except as provided in Section 8 of this Act, a

1provisions of this Act before the effective date of this
2amendatory Act of the 97th General Assembly shall be valid for
3the person to whom it is issued for a period of 10 years from
4the date of issuance. Except as provided in Section 8 of this
5Act, a Firearm Owner's Identification Card issued under the
6provisions of this Act on or after the effective date of this
7amendatory Act of the 97th General Assembly shall be valid for
8the natural life of the person to whom it is issued.

11    Sec. 13.2. The Department of State Police shall, 60 days
12prior to the expiration of a Firearm Owner's Identification
13Card issued before the effective date of this amendatory Act of
14the 97th General Assembly, forward by first class mail to each
15person whose card is to expire a notification of the expiration
16of the card and an application which may be used to apply for
17renewal of the card. It is the obligation of the holder of a
18Firearm Owner's Identification Card to notify the Department of
19State Police of any address change since the issuance of the
20Firearm Owner's Identification Card.
