AMENDMENT TO HOUSE BILL 3780

2    AMENDMENT NO. ______. Amend House Bill 3780 on page 5 by
3replacing lines 6 through 25 with the following:
 
4    "Section 25. People with Disabilities State Employment
5Council.
6    (a) The People with Disabilities State Employment Council
7is created and is made up of the members of the Interagency
8Committee on Employees with Disabilities (the Directors of the
9Departments of Human Rights, Central Management Services, and
10Veterans' Affairs, the Secretary of the Department of Human
11Services, the Chairperson of the Civil Service Commission, and
124 employees appointed by the Governor), the Co-Chairs of the
13Employment and Economic Opportunity for People with
14Disabilities Task Force, the State Superintendent of
15Education, the Director of the Department of Employment
16Security, the members of the Disability Hiring Initiative
17Committee (including the agency heads mentioned in this

1subsection (a) and the Directors of the Departments of Commerce
2and Economic Opportunity and Healthcare and Family Services),
3and the Governor's Deputy Chief of Staff for personnel issues.
4The Director of the Department of Human Rights and the
5Secretary of the Department of Human Services shall serve as
6co-chairpersons of this Council.
7    (b) The members of the People with Disabilities State
8Employment Council shall serve without compensation.
9    (c) The People with Disabilities State Employment Council
10shall examine: (1) the prevalence and impact of people with
11disabilities employed by State government; (2) the barriers
12faced by people with disabilities who seek employment or
13promotional opportunities in State government; and (3)
14possible incentives that could be offered to foster the
15employment of and the promotion of people with disabilities in
16State government.
17    (d) The Council shall meet on a quarterly basis to
18coordinate efforts to facilitate the implementation of the Act.
19    (e) The People with Disabilities State Employment Council
20shall receive administrative support from the Department of
21Central Management Services and shall issue an annual report of
22its activities each year on or before December 1, beginning
23with December 1, 2012.
 
24    Section 30. Successful disability opportunities. The
25Department of Central Management Services shall deliver or make

1available a Successful Disability Opportunities list of
2candidates each time an Open Competitive List of candidates is
3sent out, when a Successful Disability Opportunities list
4exists for the title in question.
 
5    Section 35. Disability promotion and mentoring program.
6There is created a Disability Promotion and Mentoring Program
7in State government for employees who have been hired through
8the Successful Disability Opportunities program, under which
9employment counseling on career development is provided by the
10Department of Central Management Services and the Equal
11Employment Opportunity Affirmative Action officer in each
12State executive agency shall designate a mentor for the
13employee with disabilities in his or her agency who has been
14hired through the Successful Disability Opportunities program.
 
15    Section 40. Disability exempted hiring program. There is
16created a Disability Exempted Hiring Program in State
17government for people with severe physical, psychiatric, and
18intellectual disabilities (including total deafness in both
19ears, blindness, missing extremities, partial and complete
20paralysis, epilepsy, severe intellectual disability,
21psychiatric disability, and dwarfism) under which eligibility
22for employment is determined by certification of the Department
23of Human Services' Division of Rehabilitation Services in
24collaboration with Department of Central Management Services

1based a review of the candidate's qualifications and abilities
2and the demands of the job in question. The Disability Exempted
3Hiring Program is exempted from standard examination and formal
4interview procedures to facilitate employment opportunities
5for people with the targeted disabilities named in this
6Section. When an agency elects to participate in the Disability
7Exempted Hiring Program, it shall inform the Department of
8Central Management Services, which agency shall determine in
9collaboration with the Division of Rehabilitation Services
10whether a qualified candidate with a targeted disability
11exists. Following a year of service in the title in question
12and with the recommendation of the employing agency, the
13employee shall gain certification."; and
 
14on page 6, be deleting lines 1 through 6.
