AMENDMENT TO HOUSE BILL 3294

2    AMENDMENT NO. ______. Amend House Bill 3294 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The School Code is amended by adding Section
522-32 as follows:
 
6    (105 ILCS 5/22-32 new)
7    Sec. 22-32. Task Force on School Emergency Use of
8Epinephrine.
9    (a) The School Emergency Use of Epinephrine Task Force is
10created to make recommendations on the emergency care of
11students with severe allergies when the emergencies occur at
12school and at school-sponsored activities.
13    (b) The Task Force shall be appointed and hold its first
14meeting within 90 days after the effective date of this
15amendatory Act of the 97th General Assembly.
16    (c) The Task Force shall consist of all of the following

1members:
2        (1) One representative from each of the following: The
3    Office of the Attorney General, the Department of Public
4    Health, and the State Board of Education.
5        (2) One member of the Senate appointed by the President
6    of the Senate and one member of the Senate appointed by the
7    Minority Leader of the Senate.
8        (3) One member of the House of Representatives
9    appointed by the Speaker of the House of Representatives
10    and one member of the House of Representatives appointed by
11    the Minority Leader of the House of Representatives.
12        (4) A representative of an organization representing
13    students with food allergens.
14        (5) A representative of a statewide professional
15    teachers' organization.
16        (6) A representative of a different statewide
17    professional teachers' organization.
18        (7) A representative of an organization representing
19    school management in this State.
20        (8) A representative of a statewide organization
21    representing physicians in this State.
22        (9) A representative of a statewide organization
23    representing nurses in this State.
24        (10) A representative of a statewide organization
25    representing advanced practice nurses in this State.
26        (11) A representative of a statewide organization

1    representing school nurses in this State.
2        (12) A representative of a statewide organization
3    representing public health organizations in this State.
4        (13) A representative of a statewide organization
5    representing pharmacists in this State.
6    The Task Force may call upon experts to provide additional
7information and testimony.
8    (d) The Task Force shall make recommendations for school
9district responses to anaphylaxis emergencies that occur at
10school or at school-sponsored activities in such cases where
11(i) a student's prescribed epinephrine auto-injector is not
12available when the emergency occurs or (ii) an undiagnosed
13student is showing life-threatening symptoms of anaphylaxis.
14In addition, the Task Force shall gather information and make
15recommendations concerning the permissible storage of
16emergency epinephrine auto-injectors in a school building.
17    (e) Members of the Task Force shall serve without
18compensation.
19    (f) The Task Force shall submit a report to the General
20Assembly no later than 18 months after the effective date of
21this amendatory Act of the 97th General Assembly.
22    (g) The Department of Public Health shall, with the
23assistance of the State Board of Education, provide staff and
24support and is responsible for the administration of the Task
25Force.

1    Section 99. Effective date. This Act takes effect upon
2becoming law.".
