SYNOPSIS AS INTRODUCED:
 
70 ILCS 1205/2-25  from Ch. 105, par. 2-25

    Amends the Park District Code. Provides that if a vacancy in the office of park district commissioner occurs with more than 28 months left in the term, but less than 123 days (now, 88 days) before the next regularly scheduled election for the office, the person appointed to fill the vacancy shall hold the office until the second regularly scheduled election for the office following the appointment, at which a member shall be elected to fill the vacancy for the unexpired term. Effective immediately.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Park District Code is amended by changing
5Section 2-25 as follows:
 
6    (70 ILCS 1205/2-25)  (from Ch. 105, par. 2-25)
7    Sec. 2-25. Vacancies. Whenever any member of the governing
8board of any park district (i) dies, (ii) resigns, (iii)
9becomes under legal disability, (iv) ceases to be a legal voter
10in the district, (v) is convicted of any infamous crime, (vi)
11refuses or neglects to take his or her oath of office, (vii)
12neglects to perform the duties of his or her office or attend
13meetings of the board for the length of time as the board fixes
14by ordinance, or (viii) for any other reason specified by law,
15that office may be declared vacant. Vacancies shall be filled
16by appointment by a majority of the remaining members of the
17board. Any person so appointed shall hold his or her office
18until the next regular election for this office, at which a
19member shall be elected to fill the vacancy for the unexpired
20term, subject to the following conditions:
21        (1) If the vacancy occurs with less than 28 months
22    remaining in the term, the person appointed to fill the
23    vacancy shall hold his or her office until the expiration

1    of the term for which he or she has been appointed, and no
2    election to fill the vacancy shall be held.
3        (2) If the vacancy occurs with more than 28 months left
4    in the term, but less than 123 88 days before the next
5    regularly scheduled election for this office, the person
6    appointed to fill the vacancy shall hold his or her office
7    until the second regularly scheduled election for the
8    office following the appointment, at which a member shall
9    be elected to fill the vacancy for the unexpired term.

11    Section 99. Effective date. This Act takes effect upon
12becoming law.
