20 ILCS 415/8b.7.5 new

    Amends the Secretary of State Merit Employment Code, the Comptroller Merit Employment Code, the State Treasurer Employment Code, and the Personnel Code. Provides that preferences shall be granted to qualified persons with disabilities in entrance examinations for employment positions under the separate Acts. Provides that the preference shall be in the form of points added to the final grades of the persons if they otherwise qualify and are entitled to appear on the list of those eligible for appointments.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Secretary of State Merit Employment Code is
5amended by adding Section 10b.7.5 as follows:
 
6    (15 ILCS 310/10b.7.5 new)
7    Sec. 10b.7.5. Persons with disabilities preference. For
8the granting of appropriate preference in entrance
9examinations to qualified persons with disabilities and to
10certain other persons as set forth in this Section.
11    (a) As used in this Section:
12        (1) "Person with a disability" means a person who is a
13    citizen or lawful resident of the United States and is a
14    person qualifying as being disabled.
15        (2) "Disabled" means a severe physical or mental
16    disability that:
17            (A) results from amputation, autism, blindness,
18        burn injury, cancer, cerebral palsy, Crohn's disease,
19        cystic fibrosis, deafness, head injury, hemiplegia,
20        hemophilia, respiratory or pulmonary dysfunction,
21        mental retardation, mental illness, multiple
22        sclerosis, muscular dystrophy, musculoskeletal
23        disorders, neurological disorders, including stroke

1        and epilepsy, paraplegia, quadriplegia and other
2        spinal cord conditions, sickle cell anemia, specific
3        learning disabilities, or end stage renal failure
4        disease; and
5            (B) substantially limits one or more of the
6        person's major life activities.
7        Another disability or combination of disabilities may
8    also be considered as a severe disability for the purposes
9    of this Section if it is determined by an evaluation of
10    rehabilitation potential to cause a comparable degree of
11    substantial functional limitation similar to the specific
12    list of disabilities listed in subparagraph (A) of this
13    paragraph (2).
14    (b) The preference granted under this Section shall be in
15the form of points added to the final grades of the persons if
16they otherwise qualify and are entitled to appear on the list
17of those eligible for appointments.
18    (c) A person with a disability is qualified for a
19preference of 2 points.
20    (d) The rank order of persons entitled to a preference on
21eligible lists shall be determined on the basis of their
22augmented ratings. When the Director establishes eligible
23lists on the basis of category ratings such as "superior",
24"excellent", "well qualified", and "qualified", the eligibles
25with disabilities in each such category shall be preferred for
26appointment before the eligibles without disabilities in the

1same category but not before veteran eligibles in that category
2preferred under Section 10b.7.
3    (e) The Director shall adopt rules and implement procedures
4to verify that any person seeking a preference under this
5Section is entitled to the preference. A person seeking a
6preference under this Section shall provide documentation or
7execute any consents or other documents required by the
8Director to enable the Director to verify that the person is
9entitled to the preference.
 
10    Section 10. The Comptroller Merit Employment Code is
11amended by adding Section 10b.7.5 as follows:
 
12    (15 ILCS 410/10b.7.5 new)

24Services or any other State department or agency to enable the
25department or agency to verify that the person is entitled to
26the preference.
