SYNOPSIS AS INTRODUCED:

    Amends the Illinois Vehicle Code. Provides that if a special license plate is authorized by law to raise funds for a specific cause and the Secretary of State has not received the required number of applications for that special plate within 2 years of the effective date of the Public Act authorizing the special plate, the Secretary's authority to issue the plate is nullified. Provides that revenues from special license plates shall only benefit designated charitable entities, which must be in compliance with specified requirements. Requires a charitable entity to annually provide the Secretary with a letter of compliance issued by the Attorney General's office, requires the name of the charitable entity which is to receive the funds to be provided to the Secretary within specified time limits, and provides that in the case of a failure to comply with these requirements, the special plates shall be discontinued and any undisbursed funds collected from the sale of plates authorized for that organization shall be transferred to the General Revenue Fund. Provides that if fewer than 1,000 sets of any special plate issued by the Secretary are actively registered for 2 consecutive calendar years, the Secretary may discontinue the issuance of that special plate and that discontinued plates shall be recalled and that owners of vehicles which were registered with recalled plates shall not be charged a reclassification or sticker replacement plate fee upon the issuance of new plates. Makes various changes in provisions concerning moneys collected under provisions creating special plates. Repeals provisions creating Lewis and Clark Bicentennial special plates. Effective January 1, 2012.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Vehicle Code is amended by changing
5Sections 3-600, 3-634, 3-635, 3-636, 3-643, 3-644, 3-646,
63-651, 3-652, 3-654, 3-655, 3-657, 3-658, 3-659, 3-660, 3-661,
73-662, 3-665, 3-670, 3-671, 3-672, 3-673, 3-674, 3-675, 3-678,
83-684, 3-685, 3-687, 3-689, and 3-690 and by changing and
9renumbering Sections 3-689 as added by Public Act 96-1377,
103-689 as added by Public Act 96-1449, and 3-690 as added by
11Public Act 96-1449 as follows:

13    Sec. 3-600. Requirements for issuance of special plates.
14    (a) The Secretary of State shall issue only special plates
15that have been authorized by the General Assembly. The
16Secretary of State shall not issue a series of special plates
17unless applications, as prescribed by the Secretary, have been
18received for 10,000 plates of that series; except that the
19Secretary of State may prescribe some other required number of
20applications if that number is sufficient to pay for the total
21cost of designing, manufacturing and issuing the special
22license plate. Where a special plate is authorized by law to
23raise funds for a specific civic group, charitable entity, or

1other identified organization, and where the Secretary of State
2has not received the required number of applications to issue
3that special plate within 2 years of the effective date of the
4Public Act authorizing the special plate, the Secretary of
5State's authority to issue the special plate is nullified.
6    (b) The Secretary of State, upon issuing a new series of
7special license plates, shall notify all law enforcement
8officials of the design, color and other special features of
9the special license plate series.
10    (c) This Section shall not apply to special license plate
11categories in existence on the effective date of this
12amendatory Act of 1990, or to the Secretary of State's
13discretion as established in Section 3-611.
14    (d) If a law authorizing a special license plate provides
15that the sponsoring organization is to designate a charitable
16entity as the recipient of the funds from the sale of that
17license plate, the designated charitable entity must be in
18compliance with the registration and reporting requirements of
19the Charitable Trust Act and the Solicitation for Charity Act.
20In addition, the charitable entity must annually provide the
21Secretary of State's office a letter of compliance issued by
22the Illinois Attorney General's office verifying the entity is
23in compliance with the Acts.
24    In the case of a law in effect before the effective date of
25this amendatory Act of the 97th General Assembly, the name of
26the charitable entity which is to receive the funds shall be

1provided to the Secretary of State within one year after the
2effective date of this amendatory Act of the 97th General
3Assembly. In the case of a law that takes effect on or after
4the effective date of this amendatory Act of the 97th General
5Assembly, the name of the charitable entity which is to receive
6the funds shall be provided to the Secretary of State within
7one year after the law takes effect. If the organization fails
8to designate an appropriate charitable entity within the
9one-year period, or if the designated charitable entity fails
10to annually provide the Secretary of State a letter of
11compliance issued by the Illinois Attorney General's office,
12any funds collected from the sale of plates authorized for that
13organization and not previously disbursed shall be transferred
14to the General Revenue Fund, and the special plates shall be
15discontinued.
16    (e) If fewer than 1,000 sets of any special license plate
17authorized by law and issued by the Secretary of State are
18actively registered for 2 consecutive calendar years, the
19Secretary of State may discontinue the issuance of that special
20license plate.
21    (f) Where special license plates have been discontinued
22pursuant to subsection (d) or (e) of this Section, all
23previously issued plates of that type shall be recalled. Owners
24of vehicles which were registered with recalled plates shall
25not be charged a reclassification or registration sticker
26replacement plate fee upon the issuance of new plates for those

3    (625 ILCS 5/3-634)
4    Sec. 3-634. Illinois Fire Fighters' License Plate.
5    (a) The Secretary, upon receipt of an application made in
6the form prescribed by the Secretary of State, may issue
7special registration plates designated to be Illinois Fire
8Fighters' Memorial license plates. The special plates issued
9under this Section shall be affixed only to passenger vehicles
10of the first division, motor vehicles of the second division
11weighing not more than 8,000 pounds, recreational vehicles as
12defined in Section 1-169 of this Code, and subject to the
13staggered registration system. Plates issued under this
14Section shall expire according to the multi-year procedure
15established by Section 3-414.1 of this Code.
16    (b) The design and color of the plates shall be wholly
17within the discretion of the Secretary of State. The Secretary
18of State may, in his or her discretion, allow the plates to be
19issued as vanity plates or personalized in accordance with
20Section 3-405.1 of this Code. The plates are not required to
21designate "Land of Lincoln", as prescribed in subsection (b) of
22Section 3-412 of this Code. The Secretary of State shall
23prescribe stickers or decals as provided under Section 3-412.
24    (c) An applicant shall be charged a $27 fee for original
25issuance in addition to the applicable registration fee. Of

1this additional fee, $15 shall be deposited into the Secretary
2of State Special License Plate Fund and $12 shall be deposited
3into the Illinois Fire Fighters' Memorial Fund. For each
4registration renewal period, a $17 fee, in addition to the
5appropriate registration fee, shall be charged. Of this fee, $2
6shall be deposited into the Secretary of State Special License
7Plate Fund and $15 shall be deposited into the Illinois Fire
8Fighters' Memorial Fund.
9    (d) In addition to the purpose specified in Section
102-119(n), moneys in the Illinois Fire Fighters' Memorial Fund
11shall, except as otherwise provided in subsection (e) and
12subject to appropriation by the General Assembly and
13distribution approval by the Secretary, be used exclusively for
14the following purposes:
15        (1) maintaining the Illinois Fire Fighters' Memorial;
16        (2) holding an annual memorial commemoration and Medal
17    of Honor ceremony and related activities; and
18        (3) providing scholarships, for graduate study,
19    undergraduate study, or both, to children and spouses of
20    fire fighters killed in the line of duty.
21    (e) No more than 10% of the annual proceeds of the Illinois
22Fire Fighters' Memorial Fund may, subject to appropriation by
23the General Assembly and distribution approval by the
24Secretary, be used for exhibits for and the maintenance of the
25Illinois Fire Fighter Museum.

2    Sec. 3-635. Master Mason plates.
3    (a) The Secretary, upon receipt of all applicable fees and
4applications made in the form prescribed by the Secretary, may
5issue special registration plates designated as Master Mason
6license plates.
7    The special plates issued under this Section shall be
8affixed only to passenger vehicles of the first division or
9motor vehicles of the second division weighing not more than
108,000 pounds.
11    Plates issued under this Section shall expire according to
12the multi-year procedure established by Section 3-414.1 of this
13Code.
14    (b) The design and color of the special plates shall be
15wholly within the discretion of the Secretary. Appropriate
16documentation, as determined by the Secretary, shall accompany
17each application.
18    (c) An applicant for the special plate shall be charged a
19$25 fee for original issuance in addition to the appropriate
20registration fee. Of this fee, $10 shall be deposited into the
21Master Mason Fund and $15 shall be deposited into the Secretary
22of State Special License Plate Fund, to be used by the
23Secretary to help defray the administrative processing costs.
24    For each registration renewal period, a $25 fee, in
25addition to the appropriate registration fee, shall be charged.

1Of this fee, $23 shall be deposited into the Master Mason Fund
2and $2 shall be deposited into the Secretary of State Special
3License Plate Fund.
4    (d) The Master Mason Fund is created as a special fund in
5the State treasury. All money in the Master Mason Fund shall be
6paid, subject to appropriation by the General Assembly and
7distribution approval by the Secretary, as grants to The
8Illinois Masonic Foundation for the Prevention of Drug and
9Alcohol Abuse Among Children, Inc., a not-for-profit
10corporation, for the purpose of providing Model Student
11Assistance Programs in public and private schools in Illinois.

14    Sec. 3-636. Knights of Columbus plates.
15    (a) The Secretary, upon receipt of all applicable fees and
16applications made in the form prescribed by the Secretary, may
17issue special registration plates designated as Knights of
18Columbus license plates.
19    The special plates issued under this Section shall be
20affixed only to passenger vehicles of the first division or
21motor vehicles of the second division weighing not more than
228,000 pounds.
23    Plates issued under this Section shall expire according to
24the multi-year procedure established by Section 3-414.1 of this
25Code.

1    (b) The design and color of the special plates shall be
2wholly within the discretion of the Secretary. Appropriate
3documentation, as determined by the Secretary, shall accompany
4each application.
5    (c) An applicant for the special plate shall be charged a
6$25 fee for original issuance in addition to the appropriate
7registration fee. Of this fee, $10 shall be deposited into the
8Knights of Columbus Fund and $15 shall be deposited into the
9Secretary of State Special License Plate Fund, to be used by
10the Secretary to help defray the administrative processing
11costs.
12    For each registration renewal period, a $25 fee, in
13addition to the appropriate registration fee, shall be charged.
14Of this fee, $23 shall be deposited into the Knights of
15Columbus Fund and $2 shall be deposited into the Secretary of
16State Special License Plate Fund.
17    (d) The Knights of Columbus Fund is created as a special
18fund in the State treasury. All money in the Knights of
19Columbus Fund shall be paid, subject to appropriation by the
20General Assembly and distribution approval by the Secretary, as
21grants to charitable entities designated for charitable
22purposes sponsored by the Knights of Columbus.

25    Sec. 3-643. Mammogram license plates.

1    (a) The Secretary, upon receipt of an application made in
2the form prescribed by the Secretary, may issue special
3registration plates designated as Mammogram license plates.
4The special plates issued under this Section shall be affixed
5only to passenger vehicles of the first division and motor
6vehicles of the second division weighing not more than 8,000
7pounds. Plates issued under this Section shall expire according
8to the multi-year procedure established by Section 3-414.1 of
9this Code.
10    (b) The design and color of the plates is wholly within the
11discretion of the Secretary, except that the following phrases
12shall be on the plates: (i) "Mammograms Save Lives" and (ii)
13"The Susan G. Komen Foundation". The Secretary may allow the
14plates to be issued as vanity plates or personalized under
15Section 3-405.1 of the Code. The Secretary shall prescribe
16stickers or decals as provided under Section 3-412 of this
17Code.
18    (c) An applicant for the special plate shall be charged a
19$25 fee for original issuance in addition to the appropriate
20registration fee. Of this fee, $10 shall be deposited into the
21Mammogram Fund and $15 shall be deposited into the Secretary of
22State Special License Plate Fund, to be used by the Secretary
23to help defray the administrative processing costs.
24    For each registration renewal period, a $25 fee, in
25addition to the appropriate registration fee, shall be charged.
26Of this fee, $23 shall be deposited into the Mammogram Fund and

1$2 shall be deposited into the Secretary of State Special
2License Plate Fund.
3    (d) The Mammogram Fund is created as a special fund in the
4State treasury. All money in the Mammogram Fund shall be paid,
5subject to appropriation by the General Assembly and
6distribution approval by the Secretary, as grants to the Susan
7G. Komen Foundation for breast cancer research, education,
8screening, and treatment.

11    Sec. 3-644. Police Memorial Committee license plates.
12    (a) The Secretary, upon receipt of an application made in
13the form prescribed by the Secretary, may issue special
14registration plates designated as Police Memorial Committee
15license plates. The special plates issued under this Section
16shall be affixed only to passenger vehicles of the first
17division and motor vehicles of the second division weighing not
18more than 8,000 pounds. Plates issued under this Section shall
19expire according to the multi-year procedure established by
20Section 3-414.1 of this Code.
21    (b) The design and color of the plates is wholly within the
22discretion of the Secretary. The Secretary may allow the plates
23to be issued as vanity plates or personalized under Section
243-405.1 of the Code. The Secretary shall prescribe stickers or
25decals as provided under Section 3-412 of this Code.

1    (c) An applicant for the special plate shall be charged a
2$25 fee for original issuance in addition to the appropriate
3registration fee. Of this fee, $10 shall be deposited into the
4Police Memorial Committee Fund and $15 shall be deposited into
5the Secretary of State Special License Plate Fund, to be used
6by the Secretary to help defray the administrative processing
7costs.
8    For each registration renewal period, a $25 fee, in
9addition to the appropriate registration fee, shall be charged.
10Of this fee, $23 shall be deposited into the Police Memorial
11Committee Fund and $2 shall be deposited into the Secretary of
12State Special License Plate Fund.
13    (d) The Police Memorial Committee Fund is created as a
14special fund in the State treasury. All money in the Police
15Memorial Committee Fund shall be paid, subject to appropriation
16by the General Assembly and distribution approval by the
17Secretary, as grants to the Police Memorial Committee for
18maintaining a memorial statue, holding an annual memorial
19commemoration, and giving scholarships to children of police
20officers killed in the line of duty.

23    Sec. 3-646. Organ Donor Awareness license plates.
24    (a) The Secretary, upon receipt of an application made in
25the form prescribed by the Secretary, may issue special

1registration plates designated as Organ Donor Awareness
2license plates. The special plates issued under this Section
3shall be affixed only to passenger vehicles of the first
4division and motor vehicles of the second division weighing not
5more than 8,000 pounds. Plates issued under this Section shall
6expire according to the multi-year procedure established by
7Section 3-414.1 of this Code.
8    (b) The design and color of the plates is wholly within the
9discretion of the Secretary, except that the phrase "Be An
10Organ Donor" shall be on the plates, and the design of the
11plates shall incorporate a reference to the Chicago Bears
12organization and Walter Payton. The Secretary may allow the
13plates to be issued as vanity plates or personalized under
14Section 3-405.1 of the Code. The Secretary shall prescribe
15stickers or decals as provided under Section 3-412 of this
16Code.
17    (c) An applicant for the special plate shall be charged a
18$25 fee for original issuance in addition to the appropriate
19registration fee. Of this additional fee, $10 shall be
20deposited into the Organ Donor Awareness Fund and $15 shall be
21deposited into the Secretary of State Special License Plate
22Fund, to be used by the Secretary to help defray the
23administrative processing costs.
24    For each registration renewal period, a $25 fee, in
25addition to the appropriate registration fee, shall be charged.
26Of this additional fee, $23 shall be deposited into the Organ

1Donor Awareness Fund and $2 shall be deposited into the
2Secretary of State Special License Plate Fund.
3    (d) The Organ Donor Awareness Fund is created as a special
4fund in the State treasury. Subject to appropriation by the
5General Assembly and approval by the Secretary, 50% of the
6moneys in the Organ Donor Awareness Fund shall be paid as
7grants to the Gift of Hope Organ and Tissue Donor Network
8Regional Organ Bank of Illinois, and the remaining 50% of the
9moneys in that fund shall be paid as grants to Mid-America
10Transplant Services, or pursuant to any alternative
11distribution ratio mutually agreed upon by these 2
12organizations.

15    Sec. 3-651. U.S. Marine Corps license plates.
16    (a) In addition to any other special license plate, the
17Secretary, upon receipt of all applicable fees and applications
18made in the form prescribed by the Secretary of State, may
19issue special registration plates designated as U.S. Marine
20Corps license plates to residents of Illinois who meet
21eligibility requirements prescribed by the Secretary of State.
22The special plate issued under this Section shall be affixed
23only to passenger vehicles of the first division, motorcycles,
24motor vehicles of the second division weighing not more than
258,000 pounds, and recreational vehicles as defined by Section

11-169 of this Code. Plates issued under this Section shall
2expire according to the staggered multi-year procedure
3established by Section 3-414.1 of this Code.
4    (b) The design, color, and format of the plates shall be
5wholly within the discretion of the Secretary of State, except
6that the U.S. Marine Corps emblem shall appear on the plates.
7The Secretary may, in his or her discretion, allow the plates
8to be issued as vanity or personalized plates in accordance
9with Section 3-405.1 of this Code. The plates are not required
10to designate "Land Of Lincoln", as prescribed in subsection (b)
11of Section 3-412 of this Code. The Secretary shall prescribe
12the eligibility requirements and, in his or her discretion,
13shall approve and prescribe stickers or decals as provided
14under Section 3-412.
15    (c) An applicant shall be charged a $20 fee for original
16issuance in addition to the applicable registration fee. Of
17this additional fee, $15 shall be deposited into the Secretary
18of State Special License Plate Fund and $5 shall be deposited
19into the Marine Corps Scholarship Fund. For each registration
20renewal period, a $20 fee, in addition to the appropriate
21registration fee, shall be charged. Of this additional fee, $2
22shall be deposited into the Secretary of State Special License
23Plate Fund and $18 shall be deposited into the Marine Corps
24Scholarship Fund.
25    (d) The Marine Corps Scholarship Fund is created as a
26special fund in the State treasury. All moneys in the Marine

1Corps Scholarship Fund shall, subject to appropriation by the
2General Assembly and distribution approval by the Secretary, be
3used by the Marine Corps Scholarship Foundation, Inc., a
4recognized charitable organization that meets the requirements
5of Title 26, Section 501(c)(3) of the United States Code, to
6provide grants for scholarships for higher education. The
7scholarship recipients must be the children of current or
8former members of the United States Marine Corps who meet the
9academic, financial, and other requirements established by the
10Marine Corps Scholarship Foundation. In addition, the
11recipients must be Illinois residents and must attend a college
12or university located within the State of Illinois.
13    The State Treasurer shall require the Marine Corps
14Scholarship Foundation to establish a separate account for
15receipt of the proceeds of the Marine Corps Scholarship Fund.
16That account shall be subject to audit either annually or at
17another interval, as determined by the State Treasurer.
18Proceeds from the Marine Corps Scholarship Fund shall be
19transferred on a quarterly basis by the State Treasurer's
20office to this separate account.

24    Sec. 3-652. Chicago and Northeast Illinois District
25Council of Carpenters license plates.

1    (a) The Secretary, upon receipt of all applicable fees and
2applications made in the form prescribed by the Secretary, may
3issue special registration plates designated as Chicago and
4Northeast Illinois District Council of Carpenters license
5plates.
6    The special plates issued under this Section shall be
7affixed only to passenger vehicles of the first division or
8motor vehicles of the second division weighing not more than
98,000 pounds.
10    Plates issued under this Section shall expire according to
11the multi-year procedure established by Section 3-414.1 of this
12Code.
13    (b) The design and color of the special plates shall be
14wholly within the discretion of the Secretary. Appropriate
15documentation, as determined by the Secretary, shall accompany
16each application. The Secretary may allow the plates to be
17issued as vanity plates or personalized plates under Section
183-405.1 of this Code. The Secretary shall prescribe stickers or
19decals as provided under Section 3-412 of this Code.
20    (c) An applicant for the special plate shall be charged a
21$25 fee for original issuance in addition to the appropriate
22registration fee. Of this fee, $10 shall be deposited into the
23Chicago and Northeast Illinois District Council of Carpenters
24Fund and $15 shall be deposited into the Secretary of State
25Special License Plate Fund, to be used by the Secretary to help
26defray the administrative processing costs.

1    For each registration renewal period, a $25 fee, in
2addition to the appropriate registration fee, shall be charged.
3Of this fee, $23 shall be deposited into the Chicago and
4Northeast Illinois District Council of Carpenters Fund and $2
5shall be deposited into the Secretary of State Special License
6Plate Fund.
7    (d) The Chicago and Northeast Illinois District Council of
8Carpenters Fund is created as a special fund in the State
9treasury. All moneys in the Chicago and Northeast Illinois
10District Council of Carpenters Fund shall be paid, subject to
11appropriation by the General Assembly and distribution
12approval by the Secretary, as grants to charitable entities
13designated for charitable purposes sponsored by the Chicago and
14Northeast Illinois District Council of Carpenters.

17    Sec. 3-654. Illinois Public Broadcasting System Stations
18special license plates.
19    (a) The Secretary, upon receipt of all applicable fees and
20applications made in the form prescribed by the Secretary, may
21issue special registration plates designated as Illinois
22Public Broadcasting System Stations special license plates.
23The special plates issued under this Section shall be affixed
24only to passenger vehicles of the first division or motor
25vehicles of the second division weighing not more than 8,000

1pounds. Plates issued under this Section shall expire according
2to the multi-year procedure established by Section 3-414.1 of
3this Code.
4    (b) The design and color of the special plates shall be
5wholly within the discretion of the Secretary. The Secretary
6may, in his or her discretion, allow the plates to be issued as
7vanity or personalized plates in accordance with Section
83-405.1 of this Code. The plates are not required to designate
9"Land of Lincoln", as prescribed in subsection (b) of Section
103-412 of this Code. The Secretary, in his or her discretion,
11shall approve and prescribe stickers or decals as provided
12under Section 3-412.
13    (c) An applicant for the special plate shall be charged a
14$40 fee for original issuance in addition to the appropriate
15registration fee. Of this fee, $25 shall be deposited into the

8    (a) The Secretary, upon receipt of an application made in

12to passenger vehicles of the first division and motor vehicles
13of the second division weighing not more than 8,000 pounds.

17    (b) The color of the plates is wholly within the discretion
18of the Secretary. The design of the plates shall include the
19word "Hospice" above drawings of two lilies and a butterfly.
20The Secretary may allow the plates to be issued as vanity
21plates or personalized under Section 3-405.1 of the Code. The
22Secretary shall prescribe stickers or decals as provided under
23Section 3-412 of this Code.
24    (c) An applicant for the special plate shall be charged a

2Hospice Fund and $15 shall be deposited into the Secretary of

14statewide organization whose primary membership consists of
15hospice programs to be used as follows:
16        (1) To fund projects relating to hospice care for
17    special groups, such as children, veterans, and ethnic,
18    religious, gender, or minority groups, or to provide
19    disease-specific research or outreach.
20        (2) To fund education and outreach for hospice
21    volunteers, patients, families, and health care
22    professionals.
23        (3) To fund informational and educational media
24    programs regarding the availability of hospice services.
25        (4) To fund the expansion or enhancement of a statewide
26    organization whose primary membership consists of hospice

1    programs toll-free referral line operated to provide
2    hospice information.
3        (5) To fund the expansion or enhancement of a statewide
4    organization whose primary membership consists of hospice

8    A statewide organization whose primary membership consists
9of hospice programs shall distribute grant moneys received
10under this subsection (d) through a standing committee that
11reviews funding solicitations and awards.

3must accompany each application. The Secretary, in his or her

6    (c) An applicant for the special plate shall be charged a
7$40 fee for original issuance in addition to the appropriate
8registration fee. Of this fee, $25 shall be deposited into the
9Park District Youth Program Fund and $15 shall be deposited
10into the Secretary of State Special License Plate Fund, to be
11used by the Secretary to help defray the administrative
12processing costs.
13    For each registration renewal period, a $27 fee, in
14addition to the appropriate registration fee, shall be charged.
15Of this fee, $25 shall be deposited into the Park District
16Youth Program Fund and $2 shall be deposited into the Secretary
17of State Special License Plate Fund.
18    (d) The Park District Youth Program Fund is created as a
19special fund in the State treasury. All money in the Park
20District Youth Program Fund shall be paid, subject to
21appropriation by the General Assembly and distribution
22approval by the Secretary, as grants to the Illinois
23Association of Park Districts, a not-for-profit corporation,
24for grants to park districts and recreation agencies providing
25innovative after school programming for Illinois youth.

18option. The Secretary may allow the plates to be issued as
19vanity or personalized plates under Section 3-405.1 of the
20Code. The Secretary shall prescribe stickers or decals as
21provided under Section 3-412 of this Code.
22    (c) An applicant for the special plate shall be charged a
23$40 fee for original issuance in addition to the appropriate
24registration fee. Of this fee, $25 shall be deposited into the

12prescribe rules governing the requirements and approval of the

17Illinois Pan Hellenic Trust Fund and $15 shall be deposited
18into the Secretary of State Special License Plate Fund, to be

10Illinois Delta Sigma Theta Charitable Foundation, Illinois
11Zeta Phi Beta Charitable Foundation, Illinois Sigma Gamma Rho
12Charitable Foundation, Illinois Alpha Phi Alpha Charitable
13Foundation, Illinois Omega Psi Phi Charitable Foundation,
14Illinois Kappa Alpha Psi Charitable Foundation, Illinois Phi
15Beta Sigma Charitable Foundation, or Illinois Iota Phi Theta
16Charitable Foundation for charitable purposes sponsored by the

7initiatives intended to prevent further acts of terrorism or to
8respond to further acts of terrorism or other disasters or
9emergency situations in Illinois.

2    (c) The Secretary may issue Boy Scout plates bearing the
3Eagle Scout badge only to an applicant who provides written
4proof of Eagle Scout rank, in the form of appropriate
5documentation from the National Boy Scout Council. The
6Secretary shall make these plates available to qualified
7applicants.
8    (d) The Secretary may issue Girl Scout plates bearing the
9symbol of the Gold Award only to an applicant who provides
10written proof of Gold Award status, in the form of appropriate
11documentation from the National Office of the Girl Scouts of
12the U.S.A. The Secretary shall make these plates available to
13qualified applicants.
14    (e) An applicant shall be charged a $40 fee for original
15issuance in addition to the appropriate registration fee, if
16applicable. Of this fee, $25 shall be deposited into the Boy
17Scout and Girl Scout Fund as created by this Section and $15
18shall be deposited into the Secretary of State Special License
19Plate Fund to be used by the Secretary to help defray the
20administrative processing costs. For each registration renewal
21period a $27 fee, in addition to the appropriate registration
22fee, shall be charged. Of this fee, $25 shall be deposited into
23the Boy Scout and Girl Scout Fund and $2 shall be deposited

17The address of the organization's Internet web site may appear
18on the plate, and the organization may alternate the mark to
19"Salute our Heroes!" in a manner that respects inventory. The
20field of the plate may be colored. The Secretary may, in his or
21her discretion, allow the plates to be issued as vanity or
22personalized plates in accordance with Section 3-405.1 of this
23Code. The plates are not required to designate "Land of
24Lincoln", as prescribed in subsection (b) of Section 3-412 of

1wholly within the discretion of the Secretary. Appropriate
2documentation, as determined by the Secretary, shall accompany
3each application. The Secretary may allow the plates to be
4issued as vanity plates or personalized plates under Section
53-405.1 of this Code. The Secretary shall prescribe stickers or
6decals as provided under Section 3-412 of this Code.
7    (c) An applicant for the special plate shall be charged a
8$40 fee for original issuance in addition to the appropriate
9registration fee. Of this fee, $25 shall be deposited into the
10Ducks Unlimited Fund and $15 shall be deposited into the
11Secretary of State Special License Plate Fund, to be used by
12the Secretary to help defray the administrative processing
13costs.
14    For each registration renewal period, a $27 fee, in
15addition to the appropriate registration fee, shall be charged.
16Of this fee, $25 shall be deposited into the Ducks Unlimited
17Fund and $2 shall be deposited into the Secretary of State
18Special License Plate Fund.
19    (d) The Ducks Unlimited Fund is created as a special fund
20in the State treasury. All moneys in the Ducks Unlimited Fund
21shall be paid, subject to appropriation by the General Assembly
22and distribution approval by the Secretary, as grants to Ducks
23Unlimited, Inc., a tax exempt entity under Section 501(c)(3) of
24the Internal Revenue Code, to fund wetland protection,
25enhancement, and restoration projects in the State of Illinois,
26to fund education and outreach for media, volunteers, members,

1and the general public regarding waterfowl and wetlands
2conservation in the State of Illinois, and to cover the
3reasonable cost for Ducks Unlimited special plate advertising
4and administration of the wetland conservation projects and
5education program.
