SYNOPSIS AS INTRODUCED:
 
625 ILCS 5/12-808.1 new

    Amends the Illinois Vehicle Code. Provides that all new school buses put into service on or after January 1, 2014 shall be equipped with occupant seating which has passed the ASTM E1537-07 standard test method for fire testing of upholstered furniture. Provides that seating will be deemed to have failed the ASTM E1537-07 test if (1) the seat assembly exhibits a weight loss of 3 pounds or greater during the first 10 minutes of the test; or (2) the seat assembly exhibits a heat release rate of 80 kW or greater. Provides that all plastics contained in the engine compartment of all new school buses put into service on or after January 1, 2014 shall meet the Underwriters Laboratories standard for limiting flame spread. Provides that the State Fire Marshal shall adopt rules to implement the provisions of this Act and that after the rules take effect, no new school bus shall be sold or offered for sale in this State unless the manufacturer has certified to the State Fire Marshal that the fire safety standards have been met.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Vehicle Code is amended by adding
5Section 12-808.1 as follows:
 
6    (625 ILCS 5/12-808.1 new)
7    Sec. 12-808.1. Fire resistant materials.
8    (a) No new school bus shall be put into service on or after
9January 1, 2014 unless it is equipped with occupant seating
10which meets fire safety standards described in this Section.
11    (b) School bus occupant seating must pass the ASTM E1537-07
12standard test method for fire testing of upholstered furniture.
13ASTM E1537-07 fire safety tests on school bus occupant seating
14shall be conducted on a complete seat assembly inside a test
15room or a school bus. Seating will have been deemed to have
16failed the ASTM E1537-07 test if:
17        (1) the seat assembly exhibits a weight loss of 3
18    pounds or greater during the first 10 minutes of the test;
19    or
20        (2) the seat assembly exhibits a heat release rate of
21    80 kW or greater.
22    (c) All plastic components contained in the engine
23compartment of all new school buses put in service on or after

1January 1, 2014 shall meet a V-0 classification when tested in
2accordance with the Underwriters Laboratories UL 94 standard
3for safety.
4    (d) The State Fire Marshal shall adopt rules to promote the
5fire safety of school buses and implement the provisions of
6this Section. On and after the date the rules take effect, no
7new school bus shall be sold or offered for sale in this State
8unless the manufacturer has certified to the State Fire
9Marshal, in a form acceptable to the State Fire Marshal, that
10the fire safety standards prescribed by this Section have been
11met.
