AMENDMENT TO HOUSE BILL 2568

2    AMENDMENT NO. ______. Amend House Bill 2568 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Park District Aquarium and Museum Act is
5amended by changing Section 1 as follows:
 
6    (70 ILCS 1290/1)  (from Ch. 105, par. 326)
7    Sec. 1. The corporate authorities of cities and park
8districts having the control or supervision of any public park
9or parks, are hereby authorized to purchase, erect and maintain
10within any public park or parks under the control or
11supervision of such corporate authorities, edifices to be used
12as aquariums or as museums of art, industry, science or natural
13or other history, or to permit the directors or trustees of any
14corporation or society organized for the construction or
15maintenance and operation of an aquarium or museum as
16hereinabove described to erect, enlarge, ornament, build,

1rebuild, rehabilitate, improve, maintain and operate its
2aquarium or museum or museums within any public park now or
3hereafter under the control or supervision of any city or park
4district, and to contract with any such directors or trustees
5of any such aquarium, museum or museums relative to the
6erection, enlargement, ornamentation, building, rebuilding,
7rehabilitation, improvement, maintenance and operation
8thereof. Any city or park district may charge, or permit such
9an aquarium or museum to charge, an admission fee. Any such
10aquarium or museum, however, shall be open without charge, when
11accompanied by a teacher, to the children in actual attendance
12upon grades kindergarten through twelve in any of the schools
13in this State at all times. Any such aquarium or museum in a
14county with a population of less than 3,000,000 inhabitants,
15however, must be open to the public without charge for a period
16equivalent to 26 52 days, at least 6 of which must be during
17the period from June through August, each year. Any such
18aquarium or museum in a county with a population of 3,000,000
19or more inhabitants, however, must be open to the public
20without charge for a period equivalent to 52 days, at least 6
21of which must be during the period from June through August,
22each year. Notwithstanding said provisions, charges may be made
23at any time for special services and for admission to special
24facilities within any aquarium or museum for the education,
25entertainment or convenience of visitors. The proceeds of such
26admission fees and charges for special services and special

1facilities shall be devoted exclusively to the purposes for
2which the tax authorized by Section 2 hereof may be used. If
3any owner or owners of any lands or lots abutting or fronting
4on any such public park, or adjacent thereto, have any private
5right, easement, interest or property in such public park
6appurtenant to their lands or lots or otherwise, which would be
7interfered with by the erection and maintenance of any aquarium
8or museum as hereinbefore provided, or any right to have such
9public park remain open or vacant and free from buildings, the
10corporate authorities of the city or park district having
11control of such park, may condemn the same in the manner
12prescribed for the exercise of the right of eminent domain
13under the Eminent Domain Act.

15    Section 99. Effective date. This Act takes effect upon
16becoming law.".
