AMENDMENT TO HOUSE BILL 2193

2    AMENDMENT NO. ______. Amend House Bill 2193 on page 1, by
3replacing line 15 with the following:
4    "(b) Provided that the product is not used to threaten,
5intimidate, injure, or cause distress to another, the
6restrictions of subsection (a) do not apply to:"; and
 
7on page 2, line 12, by deleting "or"; and
 
8on page 2, by replacing lines 13 through 18 with the following:
9        "(6) persons while engaged in the possession or
10    transportation, or both, of a commercial product
11    containing any of the substances specified in subsection
12    (a) for retail sale;
13        (7) persons while engaged in the possession,
14    transportation, or use, unrelated to a retail sale, of any
15    of the substances specified in subsection (a); or
16        (8) persons engaged in the possession, transportation,

1    or use of a commercial product containing any of the
2    substances specified in subsection (a)."; and
 
3on page 3, by replacing lines 22 and 23 with the following:
4    "(d) Sentence. Any violation of this Section is a business
5offense for which a fine not exceeding $150 for the first
6violation, $500 for the second violation, or $1,500 for the
7third and subsequent violations within a 12-month period shall
8be imposed."; and
 
9on page 4, by inserting immediately below line 8 the following:
 
10    "Section 99. Effective date. This Act takes effect January
