AMENDMENT TO HOUSE BILL 1957

2    AMENDMENT NO. ______. Amend House Bill 1957 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The School Code is amended by changing Section
534-210 and by adding Section 34-232 as follows:
 
6    (105 ILCS 5/34-210)
7    Sec. 34-210. The Educational Facility Master Plan.
8    (a) In accordance with the schedule set forth in this
9Article, the chief executive officer or his or her designee
10shall prepare a 10-year educational facility master plan every
115 years, with updates 2 1/2 years after the approval of the
12initial 10-year plan, with the first such educational facility
13master plan to be approved on or before January 1, 2014 July 1,
142013.
15    (b) The educational facility master plan shall provide
16community area level plans and individual school master plans

1with options for addressing the facility and space needs for
2each facility operated by the district over a 10-year period.
3    (c) The data, information, and analysis that shall inform
4the educational facility master plan shall be published on the
5district's Internet website and shall include the following:
6        (1) a description of the district's guiding
7    educational goals and standards;
8        (2) a brief description of the types of instructional
9    programs and services delivered in each school;
10        (3) a description of the process, procedure, and
11    timeline for community participation in the development of
12    the plan;
13        (4) the enrollment capacity of each school and its rate
14    of utilization;
15        (5) a report on the assessment of individual building
16    and site conditions;
17        (6) a data table with historical and projected
18    enrollment data by school by grade;
19        (7) community analysis, including a study of current
20    and projected demographics, land usage, transportation
21    plans, residential housing and commercial development,
22    private schools, plans for water and sewage service
23    expansion or redevelopment, and institutions of higher
24    education;
25        (8) an analysis of the facility needs and requirements
26    of the district; and

1        (9) identification of potential sources of funding for
2    the implementation of the Educational Facility Master
3    Plan.
4    (d) On or before July 1, 2013 January 1, 2013, the chief
5executive officer or his or her designee shall prepare and
6distribute for comment a preliminary draft of the Educational
7Facility Master Plan. The draft plan shall be distributed to
8the City of Chicago, the County of Cook, the Chicago Park
9District, the Chicago Housing Authority, the Chicago Transit
10Authority, attendance centers operated by the district, and
11charter schools operating within the district. Each attendance
12center shall make the draft plan available to the local school
13council or alternative advisory body and to the parents,
14guardians, and staff of the school. The draft plan also shall
15be distributed to each State Senator and State Representative
16with a district in the City of Chicago, to the Mayor of the
17City of Chicago, and to each alderman of the City.
18    (e) The chief executive or his or her designee shall
19publish a procedure for conducting public hearings and
20submitting public comments on the draft plan.
21    (f) After consideration of public input on the draft plan,
22the chief executive officer or his or her designee shall
23prepare and publish a report describing the process used to
24incorporate public input in the development of the final plan
25to be recommended to the Board.
26    (g) The chief executive officer shall present the final

1plan and report to the Board for final consideration and
2approval.
3    (h) The final approved Educational Facility Master Plan
4shall be published on the district's website.
5    (i) No later than January 1, 2016, and every 5 years
6thereafter, the chief executive officer or his or her designee
7shall prepare and submit for public comment a draft revised
8Educational Facility Master Plan following the procedures
9required for development of the original plan.
10    (j) This proposed revised plan shall reflect the progress
11achieved during the first 2 1/2 years of the Educational
12Facility Master Plan.

14    (105 ILCS 5/34-232 new)
15    Sec. 34-232. Proposed school action announcement and
16notice; 2012-2013 school year. The following apply for school
17actions proposed during the 2012-2013 school year:
18        (1) On or before March 31, 2013, the chief executive
19    officer shall announce all proposed school actions to be
20    taken at the close of the current academic year consistent
21    with the guidelines published under Section 34-230 of this
22    Code.
23        (2) On or before March 31, 2013, the chief executive
24    officer shall publish notice of the proposed school
25    actions.

1        (3) The chief executive officer shall provide notice of
2    proposed school actions at least 15 calendar days in
3    advance of a public hearing or meeting.
4    All other provisions of Section 34-230 of this Code that do
5not conflict with this Section must be followed when proposing
6school actions.
 
7    Section 99. Effective date. This Act takes effect upon
8becoming law.".
