    Amends the Food Handling Regulation Enforcement Act. Provides that, notwithstanding any other provision of law, neither the Department of Public Health nor the health department of a unit of local government may regulate the serving or sale of food at a charitable fundraising event or at a farmers market.

1    AN ACT concerning public health.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Food Handling Regulation Enforcement Act is
5amended by adding Sections 3.3 and 3.4 as follows:
 
6    (410 ILCS 625/3.3 new)
7    Sec. 3.3. Charitable fundraising event.
8    (a) As used in this Section, "charitable fundraising event"
9means an event that meets all of the following conditions:
10        (1) the event is sponsored by a fraternal or religious
11    organization;
12        (2) food items are sold at the event; and
13        (3) the event is conducted for the purpose of raising
14    funds for the sponsoring organization.
15    (b) Notwithstanding any other provision of law, neither the
16Department of Public Health nor the health department of a unit
17of local government may regulate the serving or sale of food at
18a charitable fundraising event.

20    Sec. 3.4. Farmers markets.
21    (a) As used in this Section, "farmers market" means a
22market held in a public space where regional farmers and

1regional food vendors sell produce and other food items to the
2public.
3    (b) Notwithstanding any other provision of law, neither the
4Department of Public Health nor the health department of a unit
5of local government may regulate the serving or sale of food at
6a farmers market.
