AMENDMENT TO HOUSE BILL 1239

2    AMENDMENT NO. ______. Amend House Bill 1239 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The School Code is amended by adding Sections
510-20.53 and 34-18.45 as follows:
 
6    (105 ILCS 5/10-20.53 new)
7    Sec. 10-20.53. Prohibition on industrially produced trans
8fat.
9    (a) For purposes of this Section:
10    "Food containing industrially produced trans fat" means a
11food that contains vegetable shortening, margarine, or any kind
12of partially hydrogenated vegetable oil, unless the
13manufacturer's documentation or the label required on the food,
14pursuant to applicable federal laws and regulations, lists the
15trans fat content as zero grams of trans fat per serving.
16    "School food service establishment" means a place that

1regularly sells or serves a food item or meal on a school
2campus.
3    (b) Each school district must not make available food
4containing industrially produced trans fat or use food
5containing industrially produced trans fat in the preparation
6of a food item served to students from any source, including,
7but not limited to, school stores, school vending machines,
8school cafeterias, school food service establishments, and
9fundraising activities on school premises.
10    (c) Subsection (b) of this Section applies to all food and
11beverages sold on school grounds during the regular and
12extended school day. The extended school day shall include
13activities such as clubs, yearbook, band and choir practice,
14student government, drama, and childcare and latchkey
15programs.
16    (d) This Section does not apply to food provided through a
17United States Department of Agriculture meal program. This
18Section does not apply to activities or programs organized and
19supervised by a private or not-for-profit organization on
20school premises.
