1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Administrative Procedure Act is
5amended by changing Section 10-65 as follows:
 
6    (5 ILCS 100/10-65)  (from Ch. 127, par. 1010-65)
7    Sec. 10-65. Licenses.
8    (a) When any licensing is required by law to be preceded by
9notice and an opportunity for a hearing, the provisions of this
10Act concerning contested cases shall apply.
11    (b) When a licensee has made timely and sufficient
12application for the renewal of a license or a new license with
13reference to any activity of a continuing nature, the existing
14license shall continue in full force and effect until the final
15agency decision on the application has been made unless a later
16date is fixed by order of a reviewing court.
17    (c) An application for Except as provided in Section 1-17
18of the Department of Natural Resources Act, an application for
19the renewal of a license or a new license shall include the
20applicant's social security number, which shall be retained in
21the agency's records pertaining to the license. As soon as
22practical, an agency must assign a customer identification
23number to each applicant for a license that the applicant may

1use in place of his or her social security number on the
2application for a license or renewal of a license. A licensee's
3social security number shall not appear on the face of his or
4her license. Each agency shall require the licensee to certify
5on the application form, under penalty of perjury, that he or
6she is not more than 30 days delinquent in complying with a
7child support order. Every application shall state that failure
8to so certify shall result in disciplinary action, and that
9making a false statement may subject the licensee to contempt
10of court. The agency shall notify each applicant or licensee
11who acknowledges a delinquency or who, contrary to his or her
12certification, is found to be delinquent or who after receiving
13notice, fails to comply with a subpoena or warrant relating to
14a paternity or a child support proceeding, that the agency
15intends to take disciplinary action. Accordingly, the agency
16shall provide written notice of the facts or conduct upon which
17the agency will rely to support its proposed action and the
18applicant or licensee shall be given an opportunity for a
19hearing in accordance with the provisions of the Act concerning
20contested cases. Any delinquency in complying with a child
21support order can be remedied by arranging for payment of past
22due and current support. Any failure to comply with a subpoena
23or warrant relating to a paternity or child support proceeding
24can be remedied by complying with the subpoena or warrant. Upon
25a final finding of delinquency or failure to comply with a
26subpoena or warrant, the agency shall suspend, revoke, or

1refuse to issue or renew the license. In cases in which the
2Department of Healthcare and Family Services (formerly
3Department of Public Aid) has previously determined that an
4applicant or a licensee is more than 30 days delinquent in the
5payment of child support and has subsequently certified the
6delinquency to the licensing agency, and in cases in which a
7court has previously determined that an applicant or licensee
8has been in violation of the Non-Support Punishment Act for
9more than 60 days, the licensing agency shall refuse to issue
10or renew or shall revoke or suspend that person's license based
11solely upon the certification of delinquency made by the
12Department of Healthcare and Family Services (formerly
13Department of Public Aid) or the certification of violation
14made by the court. Further process, hearings, or
15redetermination of the delinquency or violation by the
16licensing agency shall not be required. The licensing agency
17may issue or renew a license if the licensee has arranged for
18payment of past and current child support obligations in a
19manner satisfactory to the Department of Healthcare and Family
20Services (formerly Department of Public Aid) or the court. The
21licensing agency may impose conditions, restrictions, or
22disciplinary action upon that license.
23    (d) Except as provided in subsection (c), no agency shall
24revoke, suspend, annul, withdraw, amend materially, or refuse
25to renew any valid license without first giving written notice
26to the licensee of the facts or conduct upon which the agency

1will rely to support its proposed action and an opportunity for
2a hearing in accordance with the provisions of this Act
3concerning contested cases. At the hearing, the licensee shall
4have the right to show compliance with all lawful requirements
5for the retention, continuation, or renewal of the license. If,
6however, the agency finds that the public interest, safety, or
7welfare imperatively requires emergency action, and if the
8agency incorporates a finding to that effect in its order,
9summary suspension of a license may be ordered pending
10proceedings for revocation or other action. Those proceedings
11shall be promptly instituted and determined.
12    (e) Any application for renewal of a license that contains
13required and relevant information, data, material, or
14circumstances that were not contained in an application for the
15existing license shall be subject to the provisions of
16subsection (a).

3    Section 125. The Illinois Explosives Act is amended by
4changing Section 2002 as follows:

7Applications by individuals for original licenses shall be made
8to the Department, in writing, on forms prescribed by the
9Department. The application shall be accompanied by the
10required fee, which is not refundable. All license application
11fees collected under this provision of this Act shall be
12deposited into the Explosives Regulatory Fund. The application
13shall require such information as in the judgment of the
14Department will enable the Department to pass on the
15qualifications of the applicant for a license. It shall
16include, but need not be limited to, information concerning
17age, full name of applicant, present residence, date of birth,
18sex, physical description, social security number or drivers
19license number, and the purpose for which and the place or
20places where the explosive materials are to be used or
21possessed. Each applicant shall file, with his application,
22fingerprint based data, or other state of the art criminal
23identification data, in the form and manner required by the
24Illinois State Police to enable the Illinois State Police to

17    Sec. 30-5. Licensing of pre-license schools, school
18branches, and instructors.
19    (a) No person shall operate a pre-license school or school
20branch without possessing a valid pre-license school or school
21branch license issued by the Department. No person shall act as
22a pre-license instructor at a pre-license school or school
23branch without possessing a valid pre-license instructor
24license issued by the Department. Every person who desires to
25obtain a pre-license school, school branch, or pre-license

1instructor license shall make application to the Department in
2writing in form and substance satisfactory to the Department
3and pay the required fees prescribed by rule. In addition to
4any other information required to be contained in the
5application, every application for an original or renewed
6license shall include the applicant's Social Security number,
7which shall be retained in the agency's records pertaining to
8the license. As soon as practical, the Department shall assign
9a customer's identification number to each applicant for a
10license.
11    Every application for a renewal or restored license shall
12require the applicant's customer identification number.
13    The Department shall issue a pre-license school, school
14branch, or pre-license instructor license to applicants who
15meet qualification criteria established by rule. The
16Department may refuse to issue, suspend, revoke, or otherwise
17discipline a pre-license school, school branch, or pre-license
18instructor license or may withdraw approval of a course offered
19by a pre-license school for good cause. Disciplinary
20proceedings shall be conducted by the Board in the same manner
21as other disciplinary proceedings under this Act.
22    (b) All pre-license instructors must teach at least one
23course within the period of licensure or take an instructor
24training program approved by the Department in lieu thereof. A
25pre-license instructor may teach at more than one licensed
26pre-license school.

1    (c) The term of license for pre-license schools, branches,
2and instructors shall be 2 years as established by rule.
3    (d) The Department or the Advisory Council may, after
4notice, cause a pre-license school to attend an informal
5conference before the Advisory Council for failure to comply
6with any requirement for licensure or for failure to comply
7with any provision of this Act or the rules for the
8administration of this Act. The Advisory Council shall make a
9recommendation to the Board as a result of its findings at the
10conclusion of any such informal conference.
11    (e) For purposes of this Section, the term "pre-license"
12shall also include the 30-hour post-license course required to
13be taken to retain a broker's license.

17    Sec. 30-25. Licensing of continuing education instructors.
18    (a) No such person shall act as a continuing education
19instructor at a continuing education school or branch without
20possessing a valid continuing education instructor license and
21satisfying any other qualification criteria established by the
22Department by rule.
23    (b) After the effective date of this Act, every person who
24desires to obtain a continuing education instructor's license
25shall attend and successfully complete a one-day instructor

1development workshop, as approved by the Department. The term
2of licensure for a continuing education instructor shall be 2
3years and as established by rule. Every person who desires to
4obtain a continuing education instructor license shall make
5application to the Department in writing on forms prescribed by
6the Office, accompanied by the fee prescribed by rule. In
7addition to any other information required to be contained in
8the application, every application for an original or renewed
9license shall include the applicant's Social Security number,
10which shall be retained in the agency's records pertaining to
11the license. As soon as practical, the Department shall assign
12a customer's identification number to each applicant for a
13license.
14    Every application for a renewal or restored license shall
15require the applicant's customer identification number.
16    The Department shall issue a continuing education
17instructor license to applicants who meet qualification
18criteria established by this Act or rule.
19    (c) The Department may refuse to issue, suspend, revoke, or
20otherwise discipline a continuing education instructor for
21good cause. Disciplinary proceedings shall be conducted by the
22Board in the same manner as other disciplinary proceedings
