SYNOPSIS AS INTRODUCED:
 
730 ILCS 5/3-6-3.2 new

    Amends the Unified Code of Corrections. Provides that the Department of State Police shall establish and maintain a Statewide First Degree Murderer Database for the purpose of identifying persons convicted of first degree murder, when the murder was committed before June 19, 1998, who have been released from a penal institution or other facility after the completion of their confinement and making that information available to the public. Provides that the information in the Database shall be the names, residence addresses, places of employment, and schools attended by these offenders, and photographs of the offenders. Provides that the Department of State Police shall require such first degree murderers to register with the Department for a period of 10 years following release.

1    AN ACT concerning criminal law.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Unified Code of Corrections is amended by
5adding Section 3-6-3.2 as follows:
 
6    (730 ILCS 5/3-6-3.2 new)
7    Sec. 3-6-3.2. First degree murder committed before
8truth-in-sentencing; Database.
9    (a) The Department of State Police shall establish and
10maintain a Statewide First Degree Murderer Database for the
11purpose of identifying persons convicted of first degree
12murder, when the murder was committed before June 19, 1998, who
13have been released from a penal institution or other facility
14after the completion of their confinement and making that
15information available to the public. The Database shall be
16created from information obtained from the Department of
17Corrections and submitted to the Department of State Police.
18The information in the Database shall be the names, residence
19addresses, places of employment, and schools attended by these
20offenders, and photographs of the offenders.
21    (b) The Department of State Police must make the
22information contained in the Statewide First Degree Murderer
23Database accessible on the Internet by means of a hyperlink

1labeled "First Degree Murderer Information" on the
2Department's World Wide Web home page. The Department must make
3the information contained in the Statewide First Degree
4Murderer Database searchable via a mapping system which
5identifies first degree murderers described in subsection (a)
6living within 5 miles of an identified address. The Department
7of State Police must update that information as it deems
8necessary. The Department of State Police may require that a
9person who seeks access to the first degree murderer
10information submit biographical information about himself or
11herself before permitting access to the first degree murderer
12information. The Department of State Police must promulgate
13rules in accordance with the Illinois Administrative Procedure
14Act to implement this subsection (b) and those rules must
15include procedures to ensure that the information in the
16database is accurate.
17    (c) The Department of State Police shall require a person
18described in subsection (a) to register with the Department for
19a period of 10 years following release. The Department shall
20establish the procedures for registration.
