SYNOPSIS AS INTRODUCED:
 
50 ILCS 615/17 new

    Amends the Local Government Facility Lease Act. Provides that the corporate authorities of specified units of local government may not enter into or renew a lease with a private entity for the use of facility property (property used for the purpose of an airport, parking, or waste disposal or processing facilities) until the question of entering into or renewing the lease has been submitted to the electors of the unit of local government. Sets forth the requirements for the referendum. Effective immediately.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Local Government Facility Lease Act is
5amended by adding Section 17 as follows:
 
6    (50 ILCS 615/17 new)
7    Sec. 17. Referendum to lease facility property. On and
8after the effective date of this amendatory Act of the 96th
9General Assembly, the corporate authorities of a municipality
10or other unit of local government described in Section 5 may
11not enter into or renew a lease with a private entity for the
12use of facility property until the question of entering into or
13renewing the lease has been submitted to the electors of the
14unit of local government at a regular election and approved by
15a majority of the electors voting on the question. The
16corporate authorities must certify the question to the proper
17election authority, which must submit the question at an
18election in accordance with the Election Code.
19    The election authority must submit the question in
20substantially the following form:
 
21        Shall the (corporate authorities of the unit of local
22    government) be authorized to (enter into or renew) a lease

1    with a private entity for the use of (description of the
2    facility property)?
 
3The election authority must record the votes as "Yes" or "No".
4    If a majority of the electors voting on the question vote
5in the affirmative, the corporate authorities may enter into or
6renew a lease with a private entity for the use of the facility
7property.
 
8    Section 99. Effective date. This Act takes effect upon
9becoming law.
