AMENDMENT TO SENATE BILL 3514

2     AMENDMENT NO. ______. Amend Senate Bill 3514, AS AMENDED,
3 by inserting Article 40 in its proper numeric sequence as
4 follows:

"ARTICLE 40.

 
6     Section 5. The General Obligation Bond Act is amended by
7 changing Sections 2 and 3 as follows:
 
8     (30 ILCS 330/2)  (from Ch. 127, par. 652)
9     Sec. 2. Authorization for Bonds. The State of Illinois is
10 authorized to issue, sell and provide for the retirement of
11 General Obligation Bonds of the State of Illinois for the
12 categories and specific purposes expressed in Sections 2
13 through 8 of this Act, in the total amount of $38,049,566,143
14 $37,217,777,443.
15     The bonds authorized in this Section 2 and in Section 16 of

1 this Act are herein called "Bonds".
2     Of the total amount of Bonds authorized in this Act, up to
3 $2,200,000,000 in aggregate original principal amount may be
4 issued and sold in accordance with the Baccalaureate Savings
5 Act in the form of General Obligation College Savings Bonds.
6     Of the total amount of Bonds authorized in this Act, up to
7 $300,000,000 in aggregate original principal amount may be
8 issued and sold in accordance with the Retirement Savings Act
9 in the form of General Obligation Retirement Savings Bonds.
10     Of the total amount of Bonds authorized in this Act, the
11 additional $10,000,000,000 authorized by Public Act 93-2 and
12 the $3,466,000,000 authorized by Public Act 96-43 shall be used
13 solely as provided in Section 7.2.
14     The issuance and sale of Bonds pursuant to the General
15 Obligation Bond Act is an economical and efficient method of
16 financing the long-term capital needs of the State. This Act
17 will permit the issuance of a multi-purpose General Obligation
18 Bond with uniform terms and features. This will not only lower
19 the cost of registration but also reduce the overall cost of
20 issuing debt by improving the marketability of Illinois General
21 Obligation Bonds.

1 $7,968,463,443 is authorized to be used for the acquisition,
2 development, construction, reconstruction, improvement,
3 financing, architectural planning and installation of capital
4 facilities within the State, consisting of buildings,
5 structures, durable equipment, land, interests in land, and the
6 costs associated with the purchase and implementation of
7 information technology, including but not limited to the
8 purchase of hardware and software, for the following specific
9 purposes:
10         (a) $2,907,071,700 $2,511,228,000 for educational
11     purposes by State universities and colleges, the Illinois
12     Community College Board created by the Public Community
13     College Act and for grants to public community colleges as
14     authorized by Sections 5-11 and 5-12 of the Public
15     Community College Act;
16         (b) $1,772,020,000 $1,617,420,000 for correctional
17     purposes at State prison and correctional centers;
18         (c) $575,183,000 for open spaces, recreational and
19     conservation purposes and the protection of land;
20         (d) $664,917,000 for child care facilities, mental and
21     public health facilities, and facilities for the care of
22     disabled veterans and their spouses;
23         (e) $1,912,335,000 $1,630,990,000 for use by the
24     State, its departments, authorities, public corporations,
25     commissions and agencies;
26         (f) $818,100 for cargo handling facilities at port

1     districts and for breakwaters, including harbor entrances,
2     at port districts in conjunction with facilities for small
3     boats and pleasure crafts;
4         (g) $248,877,074 for water resource management
5     projects;
6         (h) $16,940,269 for the provision of facilities for
7     food production research and related instructional and
8     public service activities at the State universities and
9     public community colleges;
10         (i) $36,000,000 for grants by the Secretary of State,
11     as State Librarian, for central library facilities
12     authorized by Section 8 of the Illinois Library System Act
13     and for grants by the Capital Development Board to units of
14     local government for public library facilities;
15         (j) $25,000,000 for the acquisition, development,
16     construction, reconstruction, improvement, financing,
17     architectural planning and installation of capital
18     facilities consisting of buildings, structures, durable
19     equipment and land for grants to counties, municipalities
20     or public building commissions with correctional
21     facilities that do not comply with the minimum standards of
22     the Department of Corrections under Section 3-15-2 of the
23     Unified Code of Corrections;
24         (k) $5,000,000 for grants in fiscal year 1988 by the
25     Department of Conservation for improvement or expansion of
26     aquarium facilities located on property owned by a park

1     district;
2         (l) $432,590,000 to State agencies for grants to local
3     governments for the acquisition, financing, architectural
4     planning, development, alteration, installation, and
5     construction of capital facilities consisting of
6     buildings, structures, durable equipment, and land; and
7         (m) $203,500,000 for the Illinois Open Land Trust
8     Program as defined by the Illinois Open Land Trust Act.
9     The amounts authorized above for capital facilities may be
10 used for the acquisition, installation, alteration,
11 construction, or reconstruction of capital facilities and for
12 the purchase of equipment for the purpose of major capital
13 improvements which will reduce energy consumption in State
14 buildings or facilities.

17     Section 10. The Build Illinois Bond Act is amended by
18 changing Sections 2 and 4 as follows:
 
19     (30 ILCS 425/2)  (from Ch. 127, par. 2802)
20     Sec. 2. Authorization for Bonds. The State of Illinois is
21 authorized to issue, sell and provide for the retirement of
22 limited obligation bonds, notes and other evidences of
23 indebtedness of the State of Illinois in the total principal
24 amount of $4,668,609,000 $4,615,509,000 herein called "Bonds".

1 Such authorized amount of Bonds shall be reduced from time to
2 time by amounts, if any, which are equal to the moneys received
3 by the Department of Revenue in any fiscal year pursuant to
4 Section 3-1001 of the "Illinois Vehicle Code", as amended, in
5 excess of the Annual Specified Amount (as defined in Section 3
6 of the "Retailers' Occupation Tax Act", as amended) and
7 transferred at the end of such fiscal year from the General
8 Revenue Fund to the Build Illinois Purposes Fund (now
9 abolished) as provided in Section 3-1001 of said Code;
10 provided, however, that no such reduction shall affect the
11 validity or enforceability of any Bonds issued prior to such
12 reduction. Such amount of authorized Bonds shall be exclusive
13 of any refunding Bonds issued pursuant to Section 15 of this
14 Act and exclusive of any Bonds issued pursuant to this Section
15 which are redeemed, purchased, advance refunded, or defeased in
16 accordance with paragraph (f) of Section 4 of this Act. Bonds
17 shall be issued for the categories and specific purposes
18 expressed in Section 4 of this Act.

21     Sec. 4. Purposes of Bonds. Bonds shall be issued for the
22 following purposes and in the approximate amounts as set forth
23 below:
24     (a) $2,970,100,000 $2,917,000,000 for the expenses of
25 issuance and sale of Bonds, including bond discounts, and for

1 planning, engineering, acquisition, construction,
2 reconstruction, development, improvement and extension of the
3 public infrastructure in the State of Illinois, including: the
4 making of loans or grants to local governments for waste

6 distribution and purification facilities, rail or air or water
7 port improvements, gas and electric utility extensions,
8 publicly owned industrial and commercial sites, buildings used
9 for public administration purposes and other public
10 infrastructure capital improvements; the making of loans or
11 grants to units of local government for financing and
12 construction of wastewater facilities, including grants to
13 serve unincorporated areas; refinancing or retiring bonds
14 issued between January 1, 1987 and January 1, 1990 by home rule
15 municipalities, debt service on which is provided from a tax
16 imposed by home rule municipalities prior to January 1, 1990 on
17 the sale of food and drugs pursuant to Section 8-11-1 of the
18 Home Rule Municipal Retailers' Occupation Tax Act or Section
19 8-11-5 of the Home Rule Municipal Service Occupation Tax Act;
20 the making of deposits not to exceed $70,000,000 in the
21 aggregate into the Water Pollution Control Revolving Fund to
22 provide assistance in accordance with the provisions of Title
23 IV-A of the Environmental Protection Act; the planning,
24 engineering, acquisition, construction, reconstruction,
25 alteration, expansion, extension and improvement of highways,
26 bridges, structures separating highways and railroads, rest

1 areas, interchanges, access roads to and from any State or
2 local highway and other transportation improvement projects
3 which are related to economic development activities; the
4 making of loans or grants for planning, engineering,
5 rehabilitation, improvement or construction of rail and
6 transit facilities; the planning, engineering, acquisition,
7 construction, reconstruction and improvement of watershed,
8 drainage, flood control, recreation and related improvements
9 and facilities, including expenses related to land and easement
10 acquisition, relocation, control structures, channel work and
11 clearing and appurtenant work; the making of grants for
12 improvement and development of zoos and park district field
13 houses and related structures; and the making of grants for
14 improvement and development of Navy Pier and related
15 structures.
16     (b) $196,000,000 for fostering economic development and
17 increased employment and the well being of the citizens of
18 Illinois, including: the making of grants for improvement and
19 development of McCormick Place and related structures; the
20 planning and construction of a microelectronics research
21 center, including the planning, engineering, construction,
22 improvement, renovation and acquisition of buildings,
23 equipment and related utility support systems; the making of
24 loans to businesses and investments in small businesses;
25 acquiring real properties for industrial or commercial site
26 development; acquiring, rehabilitating and reconveying

1 industrial and commercial properties for the purpose of
2 expanding employment and encouraging private and other public
3 sector investment in the economy of Illinois; the payment of
4 expenses associated with siting the Superconducting Super
5 Collider Particle Accelerator in Illinois and with its
6 acquisition, construction, maintenance, operation, promotion
7 and support; the making of loans for the planning, engineering,
8 acquisition, construction, improvement and conversion of
9 facilities and equipment which will foster the use of Illinois
10 coal; the payment of expenses associated with the promotion,
11 establishment, acquisition and operation of small business
12 incubator facilities and agribusiness research facilities,
13 including the lease, purchase, renovation, planning,
14 engineering, construction and maintenance of buildings,
15 utility support systems and equipment designated for such
16 purposes and the establishment and maintenance of centralized
17 support services within such facilities; and the making of
18 grants or loans to units of local government for Urban
19 Development Action Grant and Housing Partnership programs.
20     (c) $1,352,358,100 for the development and improvement of
21 educational, scientific, technical and vocational programs and
22 facilities and the expansion of health and human services for
23 all citizens of Illinois, including: the making of construction
24 and improvement grants and loans to public libraries and
25 library systems; the making of grants and loans for planning,
26 engineering, acquisition and construction of a new State

1 central library in Springfield; the planning, engineering,
2 acquisition and construction of an animal and dairy sciences
3 facility; the planning, engineering, acquisition and
4 construction of a campus and all related buildings, facilities,
5 equipment and materials for Richland Community College; the
6 acquisition, rehabilitation and installation of equipment and
7 materials for scientific and historical surveys; the making of
8 grants or loans for distribution to eligible vocational
9 education instructional programs for the upgrading of
10 vocational education programs, school shops and laboratories,
11 including the acquisition, rehabilitation and installation of
12 technical equipment and materials; the making of grants or
13 loans for distribution to eligible local educational agencies
14 for the upgrading of math and science instructional programs,
15 including the acquisition of instructional equipment and
16 materials; miscellaneous capital improvements for universities
17 and community colleges including the planning, engineering,
18 construction, reconstruction, remodeling, improvement, repair
19 and installation of capital facilities and costs of planning,
20 supplies, equipment, materials, services, and all other
21 required expenses; the making of grants or loans for repair,
22 renovation and miscellaneous capital improvements for
23 privately operated colleges and universities and community
24 colleges, including the planning, engineering, acquisition,
25 construction, reconstruction, remodeling, improvement, repair
26 and installation of capital facilities and costs of planning,

1 supplies, equipment, materials, services, and all other
2 required expenses; and the making of grants or loans for
3 distribution to local governments for hospital and other health
4 care facilities including the planning, engineering,
5 acquisition, construction, reconstruction, remodeling,
6 improvement, repair and installation of capital facilities and
7 costs of planning, supplies, equipment, materials, services
8 and all other required expenses.
9     (d) $150,150,900 for protection, preservation, restoration
10 and conservation of environmental and natural resources,
11 including: the making of grants to soil and water conservation
12 districts for the planning and implementation of conservation
13 practices and for funding contracts with the Soil Conservation
14 Service for watershed planning; the making of grants to units
15 of local government for the capital development and improvement
16 of recreation areas, including planning and engineering costs,
17 sewer projects, including planning and engineering costs and
18 water projects, including planning and engineering costs, and
19 for the acquisition of open space lands, including the
20 acquisition of easements and other property interests of less
21 than fee simple ownership; the acquisition and related costs
22 and development and management of natural heritage lands,
23 including natural areas and areas providing habitat for
24 endangered species and nongame wildlife, and buffer area lands;
25 the acquisition and related costs and development and
26 management of habitat lands, including forest, wildlife

1 habitat and wetlands; and the removal and disposition of
2 hazardous substances, including the cost of project
3 management, equipment, laboratory analysis, and contractual
4 services necessary for preventative and corrective actions
5 related to the preservation, restoration and conservation of
6 the environment, including deposits not to exceed $60,000,000
7 in the aggregate into the Hazardous Waste Fund and the
8 Brownfields Redevelopment Fund for improvements in accordance
9 with the provisions of Titles V and XVII of the Environmental
10 Protection Act.
11     (e) The amount specified in paragraph (a) above shall
12 include an amount necessary to pay reasonable expenses of each
13 issuance and sale of the Bonds, as specified in the related
14 Bond Sale Order (hereinafter defined).
15     (f) Any unexpended proceeds from any sale of Bonds which
16 are held in the Build Illinois Bond Fund may be used to redeem,
17 purchase, advance refund, or defease any Bonds outstanding.
