SYNOPSIS AS INTRODUCED:
 
20 ILCS 515/45

    Amends the Child Death Review Team Act. Provides that the Department of Children and Family Services may, from funds appropriated by the Illinois General Assembly to the Department and provided to the Child Death Review Teams Executive Council for this purpose, establish an 18-month (rather than 3 year) pilot program in the Southern Region of the State, under which a special Child Death Investigation Task Force will be created. Provides that the Child Death Review Teams Executive Council shall submit a report to the Director of Children and Family Services, the General Assembly, and the Governor by July 1, 2011 (rather than January 1, 2010) that summarizes the results of the program. Effective immediately.

1     AN ACT concerning State government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Child Death Review Team Act is amended by
5 changing Section 45 as follows:
 
6     (20 ILCS 515/45)
7     Sec. 45. Child Death Investigation Task Force; pilot
8 program. The Child Death Review Teams Executive Council may,
9 from funds appropriated by the Illinois General Assembly to the
10 Department and provided to the Child Death Review Teams
11 Executive Council for this purpose, or from funds that may
12 otherwise be provided for this purpose from other public or
13 private sources, establish an 18-month a 3-year pilot program
14 in the Southern Region of the State, as designated by the
15 Department, under which a special Child Death Investigation
16 Task Force will be created by the Child Death Review Teams
17 Executive Council to develop and implement a plan for the
18 investigation of sudden, unexpected, or unexplained deaths of
19 children under 18 years of age occurring within that region.
20 The plan shall include a protocol to be followed by child death
21 review teams in the review of child deaths authorized under
22 paragraph (a)(5) of Section 20 of this Act. The plan must
23 include provisions for local or State law enforcement agencies,

1 hospitals, or coroners to promptly notify the Task Force of a
2 death or serious life-threatening injury to a child, and for
3 the Child Death Investigation Task Force to review the death
4 and submit a report containing findings and recommendations to
5 the Child Death Review Teams Executive Council, the Director,
6 the Department of Children and Family Services Inspector
7 General, the appropriate State's Attorney, and the State
8 Representative and State Senator in whose legislative
9 districts the case arose. The plan may include coordination
10 with any investigation conducted under the Children's Advocacy
11 Center Act. By July 1, 2011 January 1, 2010, the Child Death
12 Review Teams Executive Council shall submit a report to the
13 Director, the General Assembly, and the Governor summarizing
14 the results of the pilot program together with any
15 recommendations for statewide implementation of a protocol for
16 the investigation of investigating all sudden, unexpected, or
17 unexplained child deaths.

19     Section 99. Effective date. This Act takes effect upon
20 becoming law.
