AMENDMENT TO SENATE BILL 351

2     AMENDMENT NO. ______. Amend Senate Bill 351 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Business Enterprise for Minorities,
5 Females, and Persons with Disabilities Act is amended by
6 changing Section 4 as follows:
 
7     (30 ILCS 575/4)  (from Ch. 127, par. 132.604)
8     (Section scheduled to be repealed on June 30, 2010)
9     Sec. 4. Award of State contracts.
10     (a) Except as provided in subsection (b), not less than 12%
11 of the total dollar amount of State contracts, as defined by
12 the Secretary of the Council and approved by the Council, shall
13 be established as a goal to be awarded to businesses owned by
14 minorities, females, and persons with disabilities; provided,
15 however, that contracts representing at least five-twelfths of
16 the total amount of all State contracts awarded to businesses

1 owned by minorities, females, and persons with disabilities
2 pursuant to this Section shall be awarded to female owned
3 businesses, and that contracts representing at least one-sixth
4 of the total amount of all State contracts awarded to
5 businesses owned by minorities, females, and persons with
6 disabilities pursuant to this Section shall be awarded to
7 businesses owned by persons with disabilities.
8     The above percentage relates to the total dollar amount of
9 State contracts during each State fiscal year, calculated by
10 examining independently each type of contract for each agency
11 or university which lets such contracts. Only that percentage
12 of arrangements which represents the participation of
13 businesses owned by minorities, females, and persons with
14 disabilities on such contracts shall be included.
15     (b) In the case of State construction contracts, the
16 provisions of subsection (a) requiring a portion of State
17 contracts to be awarded to businesses owned and controlled by
18 persons with disabilities do not apply. Not less than 10% of
19 the total dollar amount of State construction contracts is
20 established as a goal to be awarded to minority and female
21 owned businesses, and contracts representing 50% of the amount
22 of all State construction contracts awarded to minority and
23 female owned businesses shall be awarded to female owned
24 businesses.
25     (c) Those who submit bids or proposals for State contracts
26 shall not be given a period after the bid or proposal is

1 submitted to cure deficiencies in the bid or proposal under
2 this Act unless mandated by federal law or regulation.
