AMENDMENT TO SENATE BILL 265

2     AMENDMENT NO. ______. Amend Senate Bill 265, AS AMENDED, by
3 replacing everything after the enacting clause with the
4 following:
 
5     "Section 5. If and only if Senate Bill 1433 of the 96th
6 General Assembly becomes law, then the State Finance Act is
7 amended by changing Section 8.49 as follows:

9     Sec. 8.49. Special fund transfers.
10     (a) In order to maintain the integrity of special funds and
11 improve stability in the General Revenue Fund, the following
12 transfers are authorized from the designated funds into the
13 General Revenue Fund:

5 All of these transfers shall be made in equal quarterly
6 installments with the first made on July 1, 2009, or as soon
7 thereafter as practical, and with the remaining transfers to be
8 made on October 1, January 1, and April 1, or as soon
9 thereafter as practical. These transfers shall be made
10 notwithstanding any other provision of State law to the
11 contrary.
12     (b) On and after the effective date of this amendatory Act
13 of the 96th General Assembly through June 30, 2010, when any of
14 the funds listed in subsection (a) have insufficient cash from
15 which the State Comptroller may make expenditures properly
16 supported by appropriations from the fund, then the State
17 Treasurer and State Comptroller shall transfer from the General
18 Revenue Fund to the fund only such amount as is immediately
19 necessary to satisfy outstanding expenditure obligations on a
20 timely basis, subject to the provisions of the State Prompt
21 Payment Act. All or a portion of the amounts transferred from
22 the General Revenue Fund to a fund pursuant to this subsection
23 (b) from time to time may be re-transferred by the State
24 Comptroller and the State Treasurer from the receiving fund
25 into the General Revenue Fund as soon as and to the extent that
26 deposits are made into or receipts are collected by the

1 receiving fund.
2     (c) If the Director of the Governor's Office of Management
3 and Budget determines that any transfer to the General Revenue
4 Fund from a special fund under subsection (a) either (i)
5 jeopardizes federal funding based on a written communication
6 from a federal official or (ii) violates an order of a court of
7 competent jurisdiction, then the Director may order the State
8 Treasurer and State Comptroller, in writing, to transfer from
9 the General Revenue Fund to that listed special fund all or
10 part of the amounts transferred from that special fund under
11 subsection (a).
