1     AN ACT concerning transportation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Vehicle Code is amended by adding
5 Sections 1-140.10, 1-140.15, and 11-1516 and by changing
6 Section 1-146 as follows:
 
7     (625 ILCS 5/1-140.10 new)
8     Sec. 1-140.10. Low-speed electric bicycle. The term
9 "low-speed electric bicycle" has the same meaning ascribed to
10 it by Section 38 of the Consumer Product Safety Act (15 U.S.C.
11 Sec. 2085).
 
12     (625 ILCS 5/1-140.15 new)
13     Sec. 1-140.15. Low-speed gas bicycle. A 2 or 3-wheeled
14 device with fully operable pedals and a gasoline motor of less
15 than one horsepower, whose maximum speed on a paved level
16 surface, when powered solely by such a motor while ridden by an
17 operator who weighs 170 pounds, is less than 20 miles per hour.

19     Sec. 1-146. Motor vehicle. Every vehicle which is
20 self-propelled and every vehicle which is propelled by electric
21 power obtained from overhead trolley wires, but not operated

1 upon rails, except for vehicles moved solely by human power,
2 and motorized wheelchairs, low-speed electric bicycles, and
3 low-speed gas bicycles. For this Act, motor vehicles are
4 divided into two divisions:
5     First Division: Those motor vehicles which are designed for
6 the carrying of not more than 10 persons.
7     Second Division: Those motor vehicles which are designed
8 for carrying more than 10 persons, those motor vehicles
9 designed or used for living quarters, those motor vehicles
10 which are designed for pulling or carrying freight, cargo or
11 implements of husbandry, and those motor vehicles of the First
12 Division remodelled for use and used as motor vehicles of the
13 Second Division.

16     Sec. 11-1516. Low-speed bicycles.
17     (a) A person may operate a low-speed electric bicycle or
18 low-speed gas bicycle only if the person is at least 16 years
19 of age.
20     (b) A person may not operate a low-speed electric bicycle
21 or low-speed gas bicycle at a speed greater than 20 miles per
22 hour upon any highway, street, or roadway.
23     (c) A person may not operate a low-speed electric bicycle
24 or low-speed gas bicycle on a sidewalk.
25     (d) Except as otherwise provided in this Section, the

1 provisions of this Article XV that apply to bicycles also apply
2 to low-speed electric bicycles and low-speed gas bicycles.
