AMENDMENT TO SENATE BILL 49

2     AMENDMENT NO. ______. Amend Senate Bill 49 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Department of Transportation Law of the
5 Civil Administrative Code of Illinois is amended by adding
6 Section 2705-585 as follows:
 
7     (20 ILCS 2705/2705-585 new)
8     Sec. 2705-585. Local Government Road Salt Purchase
9 Reimbursement Fund.
10     (a) The Local Government Road Salt Purchase Reimbursement
11 Fund is hereby created as a special fund in the State Treasury.
12 Subject to appropriation, moneys in the Fund shall be used by
13 the Department to make grants to counties, municipalities,
14 townships, and road districts in the northeastern Illinois
15 region that (i) participated in the original bid process with
16 the Department of Central Management Services for the purchase

1 of road salt for the 2008-2009 winter season, (ii) did not
2 receive a bid during that original bid process, and (iii)
3 purchased road salt for the 2008-2009 winter season at a rate
4 that exceeds the Illinois Department of Transportation Road
5 District 1 average cost of $68.59 per ton.
6     (b) Grant applications must be submitted within 150 days
7 after the effective date of this amendatory Act of the 96th
8 General Assembly. Grants shall be awarded in an amount equal to
9 the difference between (i) the amount of the contract price
10 negotiated by the Department of Central Management Services or
11 the county, municipality, township, or road district for only
12 the tonnage of road salt designated for that county,
13 municipality, township, or road district in the original
14 Central Management Services bid process and (ii) $69.00
15 multiplied by the tonnage of road salt designated for the
16 county, municipality, township, or road district in the
17 original Central Management Services bid process. However, in
18 no event may a grant award exceed $70.00 multiplied by the
19 tonnage of road salt designated for that county, municipality,
20 township, or road district in the original Central Management
21 Services bid process. Grant amounts may be prorated if moneys
22 in the Fund are not sufficient to cover the grants awarded.
23 Grants may be awarded only for the 2008-2009 winter season.
24     (c) The Secretary of Transportation shall certify to the
25 Comptroller and Treasurer when all grants have been made for
26 the 2008-2009 winter season. If any amount then remains in the

1 Fund, the Comptroller shall order transferred and the Treasurer
2 shall transfer that amount from the Local Government Road Salt
3 Purchase Reimbursement Fund to the FY09 Budget Relief Fund, and
4 the Local Government Road Salt Purchase Reimbursement Fund is
5 thereupon dissolved.
 
6     Section 10. The State Finance Act is amended by changing
7 Section 8.46 and by adding Section 5.719 as follows:
 
8     (30 ILCS 105/5.719 new)
9     Sec. 5.719. The Local Government Road Salt Purchase
10 Reimbursement Fund.

12     Sec. 8.46. Transfers to the FY09 Budget Relief Fund.
13     (a) The FY09 Budget Relief Fund is created as a special
14 fund in the State Treasury. Amounts may be expended from the
15 Fund only pursuant to specific authorization by appropriation.
16     (b) Notwithstanding any other State law to the contrary,
17 the State Treasurer and State Comptroller are directed to
18 transfer to the FY09 Budget Relief Fund the following amounts
19 from the funds specified, in equal quarterly installments with
20 the first made on the effective date of this amendatory Act of
21 the 95th General Assembly, or as soon thereafter as practical,
22 and with the remaining transfers to be made on October 1, 2008,
23 January 1, 2009, and April 1, 2009, or as soon thereafter as

13     (c) On and after the effective date of this amendatory Act
14 of the 95th General Assembly through June 30, 2009, when any of
15 the funds listed in subsection (b) have insufficient cash from
16 which the State Comptroller may make expenditures properly
17 supported by appropriations from the fund, then the State
18 Treasurer and State Comptroller shall transfer from the FY09
19 Budget Relief Fund to the fund only such amount as is
20 immediately necessary to satisfy outstanding expenditure
21 obligations on a timely basis, subject to the provisions of the
22 State Prompt Payment Act. All or a portion of the amounts
23 transferred from the FY09 Budget Relief Fund to a fund pursuant
24 to this subsection (c) from time to time may be re-transferred
25 by the State Comptroller and the State Treasurer from the
26 receiving fund into the FY09 Budget Relief Fund as soon as and

1 to the extent that deposits are made into or receipts are
2 collected by the receiving fund.
3     (d) As soon as possible after the effective date of this
4 amendatory Act of the 96th General Assembly, the Comptroller
5 shall order transferred and the Treasurer shall transfer
6 $12,900,000 from the FY09 Budget Relief Fund to the Local
7 Government Road Salt Purchase Reimbursement Fund.

9     Section 99. Effective date. This Act takes effect upon
10 becoming law.".
