1     AN ACT concerning finance.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Coal and Energy Development Bond
5 Act is amended by changing Section 6 as follows:
 
6     (20 ILCS 1110/6)  (from Ch. 96 1/2, par. 4106)
7     Sec. 6. The Department of Commerce and Economic Opportunity
8 is authorized to use general obligation bond funds for the
9 purposes of issuing grants in accordance with this Act and the
10 General Obligation Bond Act. The Department of Commerce and
11 Economic Opportunity is authorized to use $120,000,000 for the
12 purposes specified in this Act. These funds shall be expended
13 only for a grant to the owner of a generating station located
14 in Illinois and having at least three coal-fired generating
15 units with accredited summer capacity greater than 500
16 megawatts each at such generating station as specifically
17 authorized by this paragraph. Notwithstanding any of the other
18 provisions of this Act, in considering the approval of projects
19 to be funded under this Act, the Department of Commerce and
20 Economic Opportunity shall give special consideration to
21 projects which are designed to remove sulfur and other
22 pollutants in the preparation and utilization of coal, and in
23 the use and operation of electric utility generating plants and

1 industrial facilities which utilize Illinois coal as their
2 primary source of fuel. The Department of Commerce and
3 Community Affairs (now Department of Commerce and Economic
4 Opportunity) is directed to enter into a contract with the
5 owner of a generating station located in Illinois and having at
6 least three coal-fired generating units with accredited summer
7 capability greater than 500 megawatts each at such generating
8 station for a grant of $35,000,000 to be made by the State of
9 Illinois to such owner to be used to pay costs of designing,
10 acquiring, constructing, installing and testing facilities to
11 reduce sulfur dioxide emissions at one such generating unit to
12 allow that unit to meet the requirements of the Federal Clean
13 Air Act Amendments of 1990 (P.L. 101-549) while continuing to
14 use coal mined in Illinois as its source of fuel.

16     Section 10. The General Obligation Bond Act is amended by
17 changing Section 7 as follows:
 
18     (30 ILCS 330/7)  (from Ch. 127, par. 657)
19     Sec. 7. Coal and Energy Development. The amount of
20 $698,200,000 is authorized to be used by the Department of
21 Commerce and Economic Opportunity (formerly Department of
22 Commerce and Community Affairs) for coal and energy development
23 purposes, pursuant to Sections 2, 3 and 3.1 of the Illinois
24 Coal and Energy Development Bond Act, for the purposes

1 specified in Section 8.1 of the Energy Conservation and Coal
2 Development Act, for the purposes specified in Section 605-332
3 of the Department of Commerce and Economic Opportunity Law of
4 the Civil Administrative Code of Illinois, and for the purpose
5 of facility cost reports prepared pursuant to Sections 1-58
6 1-56 or 1-75(d)(4) of the Illinois Power Agency Act and for the
7 purpose of development costs pursuant to Section 8.1 of the
8 Energy Conservation and Coal Development Act. Of this amount:
9     (a) $115,000,000 is for the specific purposes of
10 acquisition, development, construction, reconstruction,
11 improvement, financing, architectural and technical planning
12 and installation of capital facilities consisting of
13 buildings, structures, durable equipment, and land for the
14 purpose of capital development of coal resources within the
15 State and for the purposes specified in Section 8.1 of the
16 Energy Conservation and Coal Development Act;
17     (b) $35,000,000 is for the purposes specified in Section
18 8.1 of the Energy Conservation and Coal Development Act and
19 making grants a grant to generating stations and coal
20 gasification facilities within the State of Illinois and to the
21 owner of a generating station located in Illinois and having at
22 least three coal-fired generating units with accredited summer
23 capability greater than 500 megawatts each at such generating
24 station as provided in Section 6 of that Bond Act;
25     (c) $13,200,000 is for research, development and
26 demonstration of forms of energy other than that derived from

1 coal, either on or off State property;
2     (d) $500,000,000 is for the purpose of providing financial
3 assistance to new electric generating facilities as provided in
4 Section 605-332 of the Department of Commerce and Economic
5 Opportunity Law of the Civil Administrative Code of Illinois;
6 and
7     (e) $35,000,000 is for the purpose of facility cost reports
8 prepared for not more than one facility pursuant to Section
9 1-75(d)(4) of the Illinois Power Agency Act and not more than
10 one facility pursuant to Section 1-58 1-56 of the Illinois
11 Power Agency Act and for the purpose of up to $6,000,000 of
12 development costs pursuant to Section 8.1 of the Energy
13 Conservation and Coal Development Act.

16     Section 99. Effective date. This Act takes effect upon
17 becoming law.
