AMENDMENT TO SENATE BILL 40

2     AMENDMENT NO. ______. Amend Senate Bill 40 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Department of Central Management Services
5 Law of the Civil Administrative Code of Illinois is amended by
6 adding Section 405-122 as follows:
 
7     (20 ILCS 405/405-122 new)
8     Sec. 405-122. Employees with a disability. The Department,
9 in cooperation with the Department of Human Services, the
10 Department of Employment Security, and other agencies of State
11 government shall develop and implement programs to increase the
12 number of qualified employees with disabilities working in the
13 State. The programs shall include provisions to increase the
14 number of people with a disability hired for positions with
15 specific job titles for which they have been assessed and
16 awarded a passing grade. The Department and the Department of

1 Human Services must submit a report, annually, to the Governor
2 and the General Assembly concerning their actions under this
3 Section.
 
4     Section 10. The Department of Human Services Act is amended
5 by adding Section 10-27 as follows:
 
6     (20 ILCS 1305/10-27 new)
7     Sec. 10-27. Information concerning federal tax credits and
8 deductions for hiring qualified employees with disabilities.
9     (a) The Department shall collect, during the period of July
10 1, 2009 through June 30, 2010, information regarding all of the
11 following:
12         (1) The number of employers that have claimed the Work
13     Opportunity Tax Credit and the amounts claimed during this
14     time frame.
15         (2) The size of the employer claiming the Work
16     Opportunity Tax Credit and whether the employer is a small
17     business or a large business.
18     (b) The Department shall cooperate with the Department of
19 Revenue, the Department of Employment Security, and other
20 appropriate agencies of State government to gather the
21 information required in items (1) and (2) of subsection (a).
22     (c) For the purposes of this Section:
23     "Large business" means a business concern, including
24 affiliates, which is not a small business.

1     "Small business" means a business concern, including
2 affiliates, with fewer than 16 employees or has gross annual
3 sales of less than $3 million.
4     (d) The Department shall submit a report, annually, to the
5 Governor and the General Assembly concerning its actions under
6 this Section.
 
7     Section 99. Effective date. This Act takes effect upon
8 becoming law.".
